Pursuant to Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, the subject proposal for a Variance has been reviewed as follows:
Variance for parking:
Required - 12 spaces
Proposed - 0 spaces
Grandfathered Credit - 8 spaces
Request to waive - 4 spaces
The following findings have been made:
• It is found that the parking deficit is a self-imposed hardship as a result of a
conversion of (8) units into a (12) studio apartment without the benefit of a building
peiinit. It is also found that there will be no visitors parking as part of this proposal.
• It is found that although the residential use is compatible with the area and will be
beneficial, the parking deficit of 4 parking spaces will have an adverse impact to the
surrounding area due to the overflow parking having to be accommodated on the
adjacent streets.
• It is found that there is no hardship to justify the requested variance.
• It is found that the subject property layout should be reconfigured back to its original
residential nonconforming characteristic of use; which only required (8) grandfathered
parking spaces.
Based on these findings, the Planning Department is recommending denial of the
application as presented.
