Dear Ms. Gelabert-Sanchez:
As per your request, Miami -Dade Aviation Department (MDAD) has reviewed the
feasibility of a proposed 158-unit residential project to be located at 4350 NW 1.0t1) Street.
According to your staff, this is an existing two-story 56 unit residential development that.
will be replaced with a proposed 158-unit residential project. Based on the available
information, MDAD has determined that the referenced property is located inside the
Outer Safety Zone (OSZ), Outer Land Use Zone (OLZ) and the Critical Approach Zone
"A" (CA -A) as depicted in the Land Use and Height Zoning Ordinance (-4 04-203) ("the
Ordinance") for Miami international Airport (MIA). The Ordinance states the following
for these restrictive zones:
OSZ: New residential construction, educational facilities (excluding aviation related
schools), and buildings for public assembly in excess of 1,000 persons are prohibited
within this zone. It is provided, however, that the prohibition on buildings for public
assembly shall not apply to hotels, motels, or hospitals and their ancillary uses.
Additionally, the .prohibition on buildings for public assembly as provided herein shall
not apply to structures used in connection with public transportation. There shall be no
variance pertaining to the residential and educational uses prohibited herein nor any
variance permitting a use for public assembly other than, as permitted in this paragraph.
OLZ: New residential construction constructed after the effective date of this ordinance
and educational facilities (excluding aviation related schools) within this land use zone
are only permitted where not otherwise prohibited and where a minimum of 25 decibel.
(db) Noise Level Reduction (NLR) materials are incorporated in the design and
construction of the structure.
CA -A: No new educational facilities (except aviation related schools and those
referenced) are permitted in the CA -A sub -zone. In no event shall this prohibition be
varied.

You should also be aware .that the property is located .74 miles from MIA's Runway
12/30 and will experience overflights of arrivals below 300 feet and departures below
1,000 feet.
It is suggested that you contact Nancy Rubin, Legal Advisor, with Miami -Dade County's
Department of Planning and Zoning for input on whether the expansion or rehabilitation
of the existing building would be allowed under the Land Use and Height Zoning
Ordinance for MIA.
