Consideration of a Resolution, approving with conditions, a
Major Use Special Permit pursuant to Articles 5, 13 and 17
of Zoning Ordinance No. 11000, as amended, for the Five
Properties project, to be located at approximately 4350
NW 10th Street, Miami, Florida, to construct an
approximate 77-foot, 7-story high residential structure to
be comprised of approximately 155 total multifamily
residential units with recreational amenities; and
approximately 321 total parking spaces; providing for
certain floor area ratio ("FAR") bonuses.

Recommended approval with conditions, including that
there be no waiver of Chapter 36, Section 36-6 (Noise
Ordinance), to City Commission on September 6, 2006 by
a vote of 6-0.
