PUBLIC WORKS ANALYSIS FOR VACATION AND CLOSURE OF THE ALLEYS LOCATED BETWEEN N.E. 2 AVENUE AND N.E. 2 COURT IMMEDIATELY NORTH OF N.E. 17 TERRACE The Plat and Street Committee has reviewed the tentative plat of "URBANA TOWERS" and determined that all technical requirements contained in the Miami City Code Subdivision Regulations have been met and has approved the tentative plat. The Plat and Street Committee has further considered the criteria contained in the Subdivision Regulations of the City Code concerning the vacation and closure of the alleys located between N.E. 2 Avenue and N.E. 2 Court immediately north of N.E. 17 Terrace and has voted 4 in favor and 0 in denial of this vacation and closure request subject to the condition that a 5 ft. wide fire access easement be provided adjacent and parallel to the existing 10 ft. wide alley along the north side of the proposed plat between N.E. 2 Avenue and N.E. 2 Court. Qlitg Tf 4Uami September 7, 2005 Urbana Development & Assoc .Lt 18851 N.R. 29 Avenue, Suite 900 Miami, FL 33138 Dear Ladies and Gentlemen: uRRANA TOWERS - NEW TENTATIVE PLAT # 1686 Located along the north side of N.E. 17 Terrace between N.E. 2 Avenue and N.E. 2 Court The City of Miami Plat and Street Committee, at its meeting of September 1, 2005, approved the above tentative plat subject to the following revisions being made to the tentative plat, additional information being provided and/or variances being granted. Please be advised that the processing of your tentative plat cannot proceed until these conditions have been satisfied. 1. In the location sketch: (a) Show the SD-20.1 overlay district designation. (b) Include Plat Books 109-16, and 140-48. (c) Show Block 13 of PB 5, PG 4. (d) Identify Biscayne Federal Plaza First Addition (PB 116-PG 7) and Omni International (PB 102-PG3) as such. 2. In the legal description identify MIRAMAR (PB 5-PG 4) as also being known as THIRD AMENDED MAP OF MIRAMAR. 3. Verity the owner's name and address, the opinion of title and warranty deed identify the owner as URBANA DEVELOPMENT ASSOCIATION, LTD. 4. In the existing zoning note include SD-20.1 Biscayne Boulevard Edgewater Overlay District; also define SD-20 as Edgewater Overlay District. 5. Provide a statement that there are no trees on the plat property. 6. All owners in the subdivision must execute the final plat. (Florida Statute 177.085). 7. At the South side of NE 17 Terrace, identify shown Lot 14 as Lot 4; also provide the block number, Block 13. 8. In the main sketch legal description, identify the underlying page number as page 4. 9. Clarify whether the proposed plat name is URBANA TOWER (Tentative) or URBANA TOWERS (Application). 10, In the Proposed Use statement provide the number of buildings. 11. Existing utilities, in the alley to be dosed and vacated, must be relocated or easements provided. An opinion of title, as to the reversionary rights for the alley to be closed and vacated, will be required by the Zoning Board. The opinion of title must also address whether or not there are individuals, in addition to abutting property owners, having an interest in the alley to be closed and vacated. _A copy ©f the opinion of title must be provided to the Public Works Department. 14.The Zoning Board will require a sketch and legal description, with a square footage, on an 8 1/2" X 11" paper, for the proposed closure. Contact Teresita Fernandez, Chief of the Hearing Boards, at (305) 416- 2030. Provide a copy to the Department of Public Works. 15. An opinion of title, in the City of Miami opinion of title form, must be provided at the time of the final plat submittal. 16. Encroachments, if any, across proposed tract lines must be removed prior to the final plat. 17. Current backup documentation will be required for all who execute the final plat. A resolution for authority to execute documents and a Certificate of Good standing from the Florida Secretary of State are required, if applicable. 18. Tentative plat application must be made with Miami -Dade County after receiving approval form the City of Miami Plat and Street Committee. 19. Before final plat submittal to the City, a copy of each the final plat and the opinion of title must be submitted to Miami -Dade County for review and then retrieved and submitted to the City, 20.The Fire Department requires a 5' wide fire access easement adjacent to the existing alley along the north side of the proposed plat. 21. The Plat and Street Committee has reviewed the tentative plat of "Urbana Towers" and determined that all technical requirements contained in the Miami City Code Subdivision Regulations have been met and has approved the tentative plat. The members of the Plat and Street Committee have further considered the request for vacation and closure of the alleys with respect to Miami City Code requirements and have voted 4 in favor and 0 in denial of this vacation and closure request subject to the condition that a 5' wide fire access easement be provided adjacent and parallel to the existing 10' wide alley along the north side of the proposed plat between N.E. 2 Avenue and N.E. 2 Court. State and local laws require the installation of various physical improvements in the public rights -of -way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. ......................................................... ........ 2, The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc. caused by this plat will be at the property owner's expense. Also, utility easements may be required on the property being platted. 3. A building permit will not be issued on the property being platted until the final plat is recorded. Also, the Certificate of Occupancy for any building construction will be issued only after all the required subdivision improvements have been completed. 4. Approval for fire flow requirements must be obtained from the Fire - Rescue Department prior to the issuance of a building permit. 5. Additional items must be provided to the City of Miami Department of Public Works before the final plat is submitted to the City Commission for approval. You will be notified in writing as to what these items are after the amount of the bond has been determined for the necessary subdivision improvements. 6. Tentative plat approval is only valid for one (1) year from the date of the Plat and Street Committee meeting at which time it was approved.
