HomeMy WebLinkAboutPlanning Analysis (OLD)PLANNING DEPARTMENT ANALYSI S Case No. 2006-00837ac CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE ALLEYS LOCATED BETWEEN NORTHEAST 17th STREET AND NORTHEAST 17th TERRACE, WEST OF NORTHEAST 2nd AVENUE. Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department has reviewed the proposed public right-of-way vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way. The following findings have been made: • It is found that this application was presented to the Plat and Street Committee on September 1, 2005 and the tentative Plat was approved with condition. (See attached analysis). • It is found that the vacations of the right of ways are required to complete a mixed use project more specifically known as, "Urbana". • It is found that upon compliance with conditions set forth below, the proposed right of way vacation will comply with Section 55-15 (c) of the Miami City Code for public benefit . Based on these findings, the Planning Department recommends approval of the request subject to the following condition by the Public Works Department. 1. A 5' wide fire access easement shall be provided adjacent and parallel to the existing 10' wide alley along the north side of the proposed plat between NE 2ti' Avenue and NE 2nd Court.
