Mr. Joseph H. Ganguzza offered the following resolution and moved its adoption
Resolution:
AFTER CONSIDERING THE FACTORS SET FORTH IN SECTION 1903.1 OF
ORDINANCE NO. 11000, THE ZONING BOARD MADE A MOTION TO APPROVE
WHICH FAILED (DUE TO THE FAILURE TO OBTAIN FIVE AFFIRMATIVE VOTES),
CONSTITUTING A DENIAL OF THE VARIANCE FROM ORDINANCE NO. 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 8,
SECTION 803, SUBSECTION 803.3.6, ADDITIONAL LIMITATIONS AND
REQUIREMENTS, TO ALLOW A REQUIRED FRONT YARD SETBACK FOR
GARAGES WITH ACCESS OPENING TO THE STREET, TO ALLOW A FRONT YARD
SETBACK OF 20'0" (40'0" REQUIRED) FOR THE PROPERTY LOCATED AT
APPROXIMATELY 3672 ROYAL PALM AVENUE, LEGALLY DESCRIBED AS LOT 4,
BLOCK E, SECOND AMENDED PLAT OF COCOANUT GROVE PARK (1-62), PUBLIC
RECORDS OF MIAMI-DADE COUNTY, FLORIDA; ZONED R-1 SINGLE FAMILY
RESIDENTIAL AND NCD-3 COCONUT GROVE NEIGHBORHOOD CONSERVATION
DISTRICT.
Upon being seconded by Mr. Carlos Martell,
the motion was passed and adopted by the following vote:
