Pursuant to Section 803.3.6.2 of Ordinance 11000, as amended, the Zoning Ordinance of
the City of Miami, Florida, the subject proposal for Variances has been reviewed as fol-
lows:
Front Yard setback:
Required - 40'-0"
Proposed - 20'-0"
Request to waive - 20'4"
The following findings have been made:
• It is found that the lot is oversized having 7,000 sq. ft., while a standard lot in an R-1
"Single Family Residential" with an NCD-3 "Coconut Grove neighborhood
conservation Overlay District" zoning is 5,000 sq. ft.
• It is found that by developing the lot in the manner reflected on the plans submitted,
the applicant will derive undue benefits under the Zoning Ordinance.
• It is found that since this proposal is new construction, it should be designed to
comply with all zoning requirements.
• It is found that the grant of the variance will not be harmony with the general intent
and purpose of the NCD-3 "Coconut Grove neighborhood conservation Overlay
District" district.
Based on these findings, the Planning Department is recommending denial of the
application as presented.
