HomeMy WebLinkAboutR-06-0606City of Miami Legislation Resolution: R-06-0606 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01692 Final Action Date: 10/12/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH HNTB ARCHITECTURE, INC., PURSUANT TO REQUEST FOR QUALIFICATIONS NO. 05-06-089, AND AS AUTHORIZED BY RESOLUTION NO. 06-0491, ADOPTED SEPTEMBER 12, 2006, TO PROVIDE ARCHITECTURAL/ENGINEERING SERVICES, FOR THE "ORANGE BOWL REDEVELOPMENT PROJECT, B-30153B," IN AN AMOUNT NOT TO EXCEED $4,500,000, FOR PHASES I -II AND THE CRITICAL EARLY PORTION OF PHASE III; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENT PROJECT NO. B-30153B; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE FINAL FEE FOR THE REMAINDER OF PHASE III, SUBJECT TO CITY COMMISSION APPROVAL. WHEREAS, the City of Miami ("City") conducted a competitive selection process, and issued a Request for Qualifications ("RFQ") No. 05-06-089, in accordance with Florida Statute 287.055 and Section 18-87 of the Code of the City of Miami, Florida, as amended, to secure a qualified outside consultant to provide Architectural/Engineering Services ("Services") for the Orange Bowl Redevelopment Project, B-30153B ("Project"); and WHEREAS, HNTB Architecture, Inc. ("Consultant") was the highest ranked firm and the City Commission, pursuant to Resolution No. 06-0491, adopted September 12, 2006, authorized the City Manager to negotiate an agreement with the Consultant; and WHEREAS, the City and the Consultant have negotiated the attached agreement and have determined that the scope of work should be structured in three (3) distinct phases relating to planning, design and construction administration; and WHEREAS, Phase I of the Project consists of documenting the existing conditions at the Orange Bowl Stadium ("Stadium") with existing conditions drawings, then utilizing these drawing as a baseline for developing design alternatives; and WHEREAS, Phase II of the Project consists of refining the list of desired and practical programmatic elements of the Project, and assisting the City in defining and selecting the full scope of work for the Stadium Redevelopment; and WHEREAS, during Phase II the Consultant will identify critical areas of the renovation work that may proceed at the beginning of 2007; and WHEREAS, Phase III consists of producing design documents, construction administration and Project close-out; and WHEREAS, currently a construction budget of $84,000,000, has been identified as available for City of Miami Page 1 of 3 File Id: 06-01692 (Version: 2) Printed On: 2/23/2017 File Number: 06-01692 Enactment Number: R-06-0606 the Project and it is understood that additional funding would enable an expanded scope of work and improved site amenities that are desirable; and WHEREAS, additional funding sources and recurring revenue opportunities will be evaluated and, if identified, may result in an increased construction budget; and WHEREAS, due to the uncertainty of the full scope of work for the Stadium Redevelopment and the potential adjustment to the final construction budget, the scope of work and the associated fees have been negotiated with the Consultant as fixed fees for Phases I and II and the critical early portion of Phase III based on the current construction budget of $84,000,00, and the fees will be subject to modification and escalation in the event the budget increases; and WHEREAS, the fixed fee for Phases I and II has been negotiated as an amount not to exceed $1,850,000 and the initial fixed fee for the critical early portion of Phase III has been negotiated as an amount not to exceed $2,650,000; and WHEREAS, the negotiated fee is not to exceed the $4,500,000; and WHEREAS, funds for the stated purpose are available from Capital Improvement Project ("CIP") B-30153B; and WHEREAS, once Phases I and II are completed and the final scope of work and construction budget determined, the final fee for the remainder of Phase III will be negotiated and approval will be sought from the City Commission to initiate the remainder of Phase III and to authorize any related amendments to the agreement with the Consultant; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as is fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with HNTB Architecture, Inc., pursuant to RFQ No. 05-06-089, to provide Services for the Project, in an amount not to exceed $4,500,000 for Phase I -II and the critical early portion of Phase III, with funds allocated from CIP NO. B-30153B. Section 3. The City Manager is authorized{1} to negotiate the final fee for Phase III subject to City Commission approval. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: City of Miami Page 2 of 3 File Id: 06-01692 (Version: 2) Printed On: 2/23/2017 File Number: 06-01692 Enactment Number: R-06-0606 {1} The authorization herein is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
