A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR JEB
BUSH AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO SUPPORT
LEGISLATION BANNING CELLULAR TELEPHONE USAGE BY MOTOR VEHICLE
DRIVERS, WHILE LOCATED IN A SCHOOL ZONE; DIRECTING THE CITY CLERK
TO TRANSMIT A COPY OF THIS RESOLUTION TO THE ELECTED OFFICIALS
DESIGNATED HEREIN.
WHEREAS, the Miami City Commission is concerned with the health, safety and welfare of minors
crossing the street in school crossing areas; and
WHEREAS, it would promote the health, safety and welfare of all residents, and in particular would
protect the youth of the state if the state were to preclude the use of cellular telephones by persons
operating a motor vehicle while located in a school crossing zone; and
WHEREAS, the Miami City Commission desire to lobby the State Legislature to amend or modify
state law as to preclude the use of cellular telephones by persons operating a motor vehicle while
located within a school crossing zone;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission urges Governor Jeb Bush and the members of the Florida
Legislature to support legislation banning cellular telephone usage by motor vehicle drivers, while
located in a school zone.
Section 3. The City Clerk is directed to transmit a copy of this Resolution to Governor Jeb Bush,
Senate President Tom Lee, House Speaker Allan Bense and the members of the Florida Legislature.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.(1)

Footnotes:
{1) if the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
