HomeMy WebLinkAboutR-06-0600City of Miami Legislation Resolution: R-06-0600 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01774 Final Action Date: 10/12/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT ("LICENSE"), REVOCABLE AT -WILL, IN SUBSTANTIALLY THE ATTACHED FORM, WITH PARTNERSHIP FOR RECOVERY, INC., A NON-PROFIT CORPORATION, TO OCCUPY AND USE SPACE 110, CONTAINING APPROXIMATELY 1,167 SQUARE FEET, WITHIN THE BUILDING OF THE CITY OF MIAMI OWNED PROPERTY LOCATED AT 1490 NORTHWEST 3RD AVENUE, MIAMI, FLORIDA, FOR USE AS OFFICE SPACE IN CONNECTION WITH THEIR "NO BLUE ROOFS" CAMPAIGN, WHICH LICENSE SHALL PROVIDE FOR A ONE-TIME USE FEE OF $1.00, AND A USE PERIOD TO COMMENCE UPON EXECUTION OF THE LICENSE AND EXPIRE NINE (9) MONTHS THEREAFTER, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT. WHEREAS, the City of Miami ("City") is the owner of real property located at 1490 Northwest 3rd Avenue, Miami, Florida, also known as the Overtown Shopping Center ("Property"); and WHEREAS, Partnership for Recovery, Inc. ("Licensee") is a non-profit public/private organization which raises funds to aid Miami and Miami -Dade County residents impacted by Hurricane Wilma; and WHEREAS, the Licensee has requested use of space within the Property for use as office space in connection with their "No Blue Roofs" campaign; and WHEREAS, since a significant number of blue roofs are located within the City, the City Commission has determined it to be in the City's best interest to provide this space to the Licensee at a nominal fee as its contribution to this initiative; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Revocable License Agreement ("License"), revocable at -will, in substantially the attached form, with Licensee to occupy and use space 110, containing approximately 1,167 square feet, within the building of the City -owned property located at 1490 Northwest 3rd Avenue, Miami, Florida, for use as office space in connection with their "No Blue Roofs" campaign, which License shall provide for a one-time use fee of $1.00, and a use period to commence upon execution of the License and to expire nine (9) months thereafter, with terms and conditions as more particularly set forth in said agreement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of City of Miami Page 1 of 2 File Id: 06-01774 (Version: 1) Printed On: 2/23/2017 File Number: 06-01774 Enactment Number: R-06-0600 the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
