HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01687 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S) AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI-DADE WATER AND SEWER DEPARTMENT, FOR THE PROVISION OF WATER AND SANITARY SEWER SERVICES, FOR THE LITTLE HAITI PARK CULTURAL CAMPUS, PROJECT B-30295. WHEREAS, the City of Miami ("City") has established a capital improvement project to design and construct a cultural campus at Little Haiti Park, located at Northeast 2nd Avenue and Northeast 59th Street, Miami, Florida; and WHEREAS, said project has been incorporated into the City's Capital Improvement Program and Multi -year Plan as Project No. B-30295" ("Project"); and WHEREAS, the scope of work for the entire Project is to create a cultural arts building (black box theater), a community center, courtyard, amenities and related sitework; and WHEREAS, the Project is underway with an anticipated substantial completion date of 2008 and the Department of Capital Improvements and Transportation ("Department") is diligently working to maintain this schedule and requires water and sanitary sewer facilities to proceed on schedule; and WHEREAS, the Miami -Dade Water and Sewer Department ("WASD") is the sole provider of water and sanitary sewer services in Miami -Dade County and has agreed to provide the needed services; and WHEREAS, the Department has negotiated an agreement with WASD to provide said services; and WHEREAS, the City Manager requests authorization to execute an Agreement with WASD, in substantially the attached form, to provide for these services; and WHEREAS, any charges for upgrading the existing infrastructure or connection to the WASD utilities will be paid by the contractor and funds are not required from the City at this time; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1) to execute an Agreement, in substantially the attached form, with WASD, for the provision of water and sewer services, for the Project. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APP +sVED AS TO FORM AND C• : RECTNESS: JORG RNANDEZ CITY e ' NEY U�( Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
