UNITY OF TITLE
WHEREAS, the undersigned is the owner of that property legally described
as:
Parcel A: Lot 7B, 8B, 9B, 10B and 118 of RIVERSIDE WATERFRONTS, according to the
Plat thereof, recorded in Plat Book 25 at Page 72 of the Public Records of
Miami -Dade County, Florida, LESS: Begin at the most Northeasterly corner
of said Lot 11 B, being at a point on U.S. Harbor line as shown on above
described plat, thence South 87° 56' 55" West, 139.83 feet along the lot
line of said Lot 11 B to the beginning of a curve concave Northeasterly
having a radius of 50feet, thence Southwesterly, Westerly, and
Northwesterly 56.85 feet along said curve through a central angle of 65°
08' 42" to end of curve, thence North 26° 54' 23" West 16.63 feet, thence
North 21° 13' 45" east 137.92 feet to a point on said U.S. Harbor line being
the most Northwesterly corner of said parcel described herein, thence
South 32° 49' 05" East 5 feet along said U.S. Harbor line, thence South 41°
07' 04" East 214.41 feet along said U.S. Harbor line to point of beginning.

The undersigned recognized and acknowledges that for the public health, welfare,
safety and/ or morals, the herein -described property should not be divided into

separate parcels owned by several owners so long as the same is put to the hereinafter
use, and
In consideration of the issuance of a development permit:
The facility includes a gymnasium, a fitness center, an aerobics facility, locker rooms,
administrative offices, storage space and a sealing area for 500 people, which will
provide additional community meeting place for Miami residents.
The City of Miami intends to issue a building permit for this project subject to the
provisions of this Unity.
And for other good and valuable considerations, the undersigned hereby agrees to
restrict the use of the subject property in the following manner;
1. That said property (all of the lots and/or parcels of land encompassing the
building site ) shall be considered and held together as one plot and parcel of
land and that no portion of said plot and parcel of land shall be sold, transferred,
leased, encumbered, divided or assigned separately, except in its entirety as one
plot or parcel of land;
2. The undersigned further agrees that this condition.(s), restriclion(s) and limitation(s)
shall be deemed a covenant running with land, which shall be recorded in the
public records of Miami Dade County, at the undersigned's cost and expense,
and shall remain in full force and effect and be binding upon the undersigned,
their heirs ,successors, and assigns until such time as the same may be released in
writing by the Director of the Planning Department and/or the Zoning Director or
his / her designated representative; provided, however, that this Unity of Title may
be released in writing by the Director of the Planning Department and /or the
Zoning Director or his / her designated representative, after approval of site plan
which meets all applicable City regulations. The undersigned shall promptly
provide a copy of this instrument within thirty {30) days of it's' recordation. The
unity of title shall be approved as to legal form and content by the City Attorney.
