CONSTRUCTION, INC., THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER PURSUANT TO INVITATION FOR BIDS NO. 05-06-095, RECEIVED AUGUST 8, 2006, FOR THE PROJECT ENTITLED "CITYWIDE SIDEWALK REPAIR PROJECT, PHASE 29 (SECOND BIDDING), B-43114A," FOR AN INITIAL TERM OF ONE-YEAR, IN AN ANNUAL AMOUNT NOT TO EXCEED $917,000, WITH FOUR (4) OPTIONS TO RENEW THE TERM,t EACH FOR AN ADDITIONAL ONE (1) YEAR PERIOD, IN THE CITY'S DISCRETION AND SUBJECT TO AVAILABILITY OF FUNDING AN❑ CONTRACTOR'S PERFORMANCE; ALLOCATING FUNDS, FROM CAPITAL IMPROVEMENT ACCOUNT NO. 341330, IN THE AMOUNT OF $917,000 TO COVER THE CONTRACT COST AND $30,000 TO COVER THE ESTIMATED PROJECT EXPENSES, FOR AN ESTIMATED TOTAL COST OF $947,000; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PROJECT. WHEREAS, the City of Miami ("City") issued Invitation for Bids No. 05-06-095, for the Project entitled "Citywide Sidewalk Repair Project, Phase 29 (Second Bidding) B-43114A; and WHEREAS, the bid of M.E.F. Construction, Inc. was the lowest responsive and responsible bid, as stated on the formal bid documents and the Department of Public Works Project Fact Sheet attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted and incorporated as if fully set forth in this Section. Section 2. The bid received August 8, 2006, pursuant to Invitation for Bids No. 05-06-095, from M.E.F. Construction, Inc., the lowest responsive and responsible bidder, for the project entitled "Citywide Sidewalk Repair Project, Phase 29 (Second Bidding), B-43114A," in the annual amount not to exceed $917,000, is accepted, with funds allocated from Capital Improvements Account No. 341330, in the amount of $917,000 to cover contract costs plus $30,000 to cover estimated expense incurred by the City, for an estimated total project cost of $947,000. Section 3. The City Manager is authorized(1) to execute an Agreement, in substantially the attached form , for said Project for an initial term of one (1) year, with four (4) options to renew the term, each for an additional one (1) year period, in the City's discretion, subject to availability of annual funding and contractors's performances. APPROVED AS TO FORM AND CORRECTNESS: Footnotes : {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
