AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 621
ARTICLE IV/ SECTION 62-93, ENTITLED "ZONING AND PLANNING/ZONING
BOARD/PROCEEDINGS," TO ELIMINATE THE REQUIREMENT OF OBTAINING
FIVE AFFIRMATIVE VOTES FOR THE PASSAGE OF ANY ITEM PRESENTED TO
THE ZONING BOARD; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Chapter 62, Article IV, Section 62-93 of the Code of the City of Miami, Florida, is
amended in the following particulars:{1}
"Chapter 62
ZONING AND PLANNING
ARTICLE IV. ZONING BOARD
Sec. 62-93. Proceedings.
(a) Officers and voting. The zoning board shall select a chairman and a vice-chairman from among its
members and may create and fill such other offices as it may determine. All members or the alternate
member, sitting in place of a member, shall be required to vote on matters before the board, subject to
the provisions of subsection (e) of this section and applicable Florida statutes.
(b) Rules of procedure. The zoning board shall establish rules of procedure necessary to its
governance and the conduct of its affairs, in keeping with the applicable provisions of Florida law, the
city Charter and city ordinances and resolutions. Such rules of procedure shall be available in written
form to persons appearing before the zoning board and to the public upon request.
(c) Meetings. The zoning board shall hold at least two regularly scheduled meetings each month,
except the month of August, on days to be determined by the board. Other regularly scheduled
meetings may be set by the board and additional meetings may be held at the call of the chairman and
at such other times as the zoning board may determine. Meetings that are not regularly scheduled
shall not be held without at least 24 hours' notice to each member and alternate member. The zoning
board shall have the power to take testimony under oath.
(d) Quorum; public records. The zoning board shall keep detailed minutes of its proceedings, showing
the vote of each member or alternate member, if sitting for a member, or if absent or failing to vote
under subsection (e) of this section, indicating such fact. The zoning board shall keep records of its

examinations and other official actions, all of which shall be a public record and filed immediately in the
office of the city clerk. A quorum for the transaction of business shall consist of five members, and

Section 2. Ali ordinances or parts of ordinances insofar as they are inconsistent or in conflict with
the provisions of this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Ordinance, it shall become effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is later.
