Dear Hon. Mayor and Commissioners;
As property owners and stakeholders in Overtown, we are in full support of Royal Palm's
zoning application to rezone the properties west of NW I" Avenue between Interstate
395 and NW 10th Street (Overtown) under the Special District (SD) 16 zoning code. This
zoning application is consistent with the 2004 Southeast Overtown/Park West
Redevelopment Plan and this community's vision for the NW 14 Avenue Corridor. The
zoning request, when approved, would allow for several dense mix -use projects along
NW 1'` Avenue that would have a great economic impact to Overtown residents in terms
of new jobs created. Other benefits include the removal of existing slum and blighted
areas, which constitute a serious, and growing menace, injurious to the public health,
safety, morals, and welfare of the residents of the community, and increased Tax
Increment Funds (TIF) revenue to the Community Redevelopment Agency that would be
used to further redevelop the Overtown neighborhood. As real estate taxes continue to
escalate, there is an urgent need to provide property owners with the resources and
development opportunities to allow them to quickly and fully capitalize on their land
investments and in turn, expedite the economic development of Overtown. It is
imperative that this zoning application be approved to stimulate development and allow
Overtown to share in the same development opportunities currently being offered on
properties east of NW 14 Avenue.
This zoning request is scheduled for the November commission meeting. We seek your
favorable decision in approving this zoning application and would further request that
this letter be made part of the public record when this item is heard at the City

COMPELLING REASONS TO APPROVE THIS ZONING REQUEST
1. HEATH AND PUBLIC SAFETY CONCERNS. The properties represented
in this zoning request is located within the Southeast Overtown/Park West
("SEOPW") Community Redevelopment Area; an area designated as slum
and blight, and defined by Florida Statutes 163.335 (1) as an area which
constitute a serious and growing menace, injurious to the public health,
safety, morals, and welfare of the residents of the state;". The legislation
continues that the existence of such areas "contributes substantially and
increasingly to the spread of disease and crime, constitutes an economic
and social liability imposing onerous burdens which decrease the tax base
and reduce tax revenue, substantially impairs or arrests sound
grown...land! retards the provision of housing accommodations." These
are all conditions that are present today in the Overtown neighborhood.
Needed Action: Review and approval of projects that will remove slum and
blight conditions, provide for public health to be restored and maintain. and
that reduce the strain on city resources (i.e., police, code enforcement,
building etc).
2. REMOVAL OF SLUM & BLIGHT. Neighborhood conditions have existed
since the construction of the highways in the `60s that bisected Overtown and
severely impacted Overtown's economic viability. Since 1972, city and
county officials have enacted legislation and plans. tailored to revitalize the
Overtown neighborhood. Each resulting plan (Treasure Coast Plan,
Overtown Civic Partnership Plan, 2004 SEOPW Redevelopment Plan, etc)
provided for similar concepts and development incentives to be in place to
ensure development takes hold in the community. It would not be
conceivable for residents and stakeholders to wait for the completion of the
Miami 21 Plan before. they can see the improvements within their
neighborhood
Needed Action: Immediate review and consideration of this zoning request
and approval based on consistency with existing plans and the 2004 SEOPW
Redevelopment Plan which provides the guidelines for development within
the CRA area.
ECONOMIC INSTABILITY FOR PROPERTY OWNERS. As
developers/investors acquire properties within the neighborhood, they are
quickly confronted with neighborhood conditions which impact the
marketability of their properties (i.e., code violations. homelessness. drug and
gang related activities, vandalism, etc). Compounded by the lack of
development incentives and the ever increasing property taxes. many property
owners resort to quickly selling their properties to other investors unfamiliar
with the neighborhood. The resulting tlipping of properties have created a
negative situation for existing (native) ()yellow) residents who can no linger
afford the staggering increased property taxes and are forced to sell or faced
Ioreclosure proceedings. With the lack of individuals patronizing these
businesses and the lack of incentives to attract tenants, what few businesses
were able to stay afloat in Overtown have had to close their shop permanently.
Needed Action: Developers, Investors, Property Owners and Patrons need to
see development taking place in the neighborhood to show that there is a
commitment by all to see Overtown redeveloped into a prosperous
community. Upzoning of properties, consistent with the 2004 SEOPW
Redevelopment Plan will allow property owners to market their properties
effectively and compete with neighboring communities for long term
commercial and residential tenants leases.
4. ENCOURAGEMENT OF PRIVATE ENTERPRISE. The Legislation that
created the Southeast Overtown/Park West Redevelopment District strongly
encourage the development of redevelopment areas through private enterprise
and states that "Any county or municipality. to the greatest extent...shall
afford maximum opportunity...to the rehabilitation or redevelopment of the
community redevelopment area by private enterprise" F.S. 163.345 (1). The
legislation further encourages county and municipality to use consideration in
exercising its "zoning powers: the enforcement of other laws, codes. and
regulations relating to the use of land and the use of and occupancy of
buildings and improvements"
Needed Action: Immediate review and approval of this zoning request which
is consistent with the 2004 SEOPW Redevelopment Plan which provides the
guidelines for development within the CRA area, and which allows for
development to take place with the use of private funds.
5. PRECEDENCE_. OF "DEVELOPER UNFRIENDLY" WITHIN OVERTOWN
NEIGHBORIHOOD. Since 1972, Overtown has lie dormant although the city
of Miami is experiencing an unprecedented development boom. Very few
major developers have taken the initiative to commence projects in the
Overtown neighborhood and those who have done so. experienced hardships
in terms of getting projects approved, having project delayed due to the need
to address special neighborhood issues, which have resulted in overall
increased project costs (i.e.. labor and construction cost. debt service
payments. etc). Interested investors and developers alike are taken a serious
look at how the City is coping and addressing developmental issues in this
neighborhood. Without development incentives and favorable development
conditions. there will he a continuation or the flipping of properties which
overall keeps Overtown in the same condition it has been for the past forty
years.

6. ZONING CONSISTENCY. This zoning request is consistent with the 2004
Southeast Overtown/Park West Redevelopment Plan, prepared by Dover.
Kohl & Partners, which calls for higher density consistent with SD-16 zoning
along the NW 1'' Avenue co►7idor. Properties fronting the NW 1 `' Avenue
corridor currently have the SD-16 designation and this zoning request would
allow for the remaining properties to be zoned SD-16 for consistency. The
regulatory plan that is being prepared by Dover Kohl & Partners also shows
the increased density along NW I" Avenue. Two future projects, just one
block south of the subject properties, recently awarded by the City of Miami
(Crosswinds project, and the Black Archives — Block 36 project) will be
developed on properties zoned SD-16 with plans calling for mixed -used
residential projects.
Needed Action: Immediate review and approval of this zoning request
consistent with 2004 SEOPW Redevelopment Plan and surrounding zoning.
7. INCREASED FAX INCREMENT FUNDS FOR CREATION OF
AFFORDABLE EIOUSiNG. The subject properties are located within the
SEOPW Redevelopment Area which is a Tax Increment Fund (h1F) district.
As new development takes place, the increased tax revenue collected by the
city and county governments are returned to the Redevelopment Trust Fund to
finance projects within the redevelopment area. The focus of the CRA is on
affordable housing and providing incentives to developers to ensure that
sufficient affordable housing is built within the area. This project once
completed will generate $300,000 more in tax revenue each year that will he
used to further development within the community.
Needed Action: Approval of this zoning request would provide additional
funds for development of the SEOPW redevelopment area, thus further
eliminating slum and blight conditions and positively improving the lives of
residents.
