To support the application: (a) A 1 Q-feet right of way dedication along the longest side of the lot scientifically decreases the build ability of the property. (b) The dedication is a D.O.T. requirement imposed on the site. (c) An unnecessary hardship is created by adding the seven foot and six inches set back to the ten feet dedication by creating a seventeen feet and six inches wide band along the longest side of the property of unused space. (d) The variance is requested for part of the setbacks and for a trade off in absolute unbuildable setback as opposed to open public space in an urban setting. (e) By granting the variance the building allows for acceptable livable space to face Eight Street and still have enough usable width for the building mechanics to work. These livable spaces and/or retail areas at a pedestrian level are the very principle that emphasizes a proper urban treatment of a corridor of this scale. (a) The design proposes a building mass that encroaches into the set backs at the pedestrian level but offers a 15-foot wide colonnade (twice the required setback required on that side) in addition to the ten feet dedication. This proposal speaks of a pedestrian oriented urban design with liner units above retail frontage protected from the elements with arcades and covered walkways.
