HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01418 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), EXPANDING THE BOUNDARIES OF THE CITY OF MIAMI DESIGNATED BROWNFIELD AREAS, TO INCLUDE THE AUGMENTED (01/01/06) ENTERPRISE ZONE AS ILLUSTRATED AND DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED, IN ACCORDANCE WITH FLORIDA STATUTES SECTION 376.80(2)(A) OF THE BROWNFIELDS REDEVELOPMENT ACT, WHICH WILL FACILITATE THE ASSESSMENT, REHABILITATION AND REDEVELOPMENT OF PROPERTIES WITHIN THE BROWNFIELDS AREA THAT HAVE BEEN DETERMINED TO HAVE A CRITICAL NEED FOR REDEVELOPMENT; AUTHORIZING THE CITY MANAGER TO NOTIFY THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION AND THE MIAMI-DADE COUNTY DEPARTMENT OF ENVIRONMENTAL RESOURCES MANAGEMENT OF SAID EXPANSION; AND AUTHORIZING AND DIRECTING THE CITY MANAGER TO UNDERTAKE ANY OTHER NECESSARY RELATED PROCEDURES, NOTICES, AND REQUIREMENTS FOR SAID DESIGNATION, FOR SAID PURPOSES. WHEREAS, the State of Florida has provided in Chapter 376.77 - 376.84, Florida Statutes ("The Brownfields Redevelopment Act"), for the designation, by resolution, of contiguous areas consisting of one or more Brownfields Sites to be known as Brownfields Areas, and for the provision of environmental assessment, remediation, rehabilitation and economic development of such areas; and WHEREAS, Brownfields Sites are defined as real property where expansion or redevelopment is complicated by actual or perceived environmental contamination; and WHEREAS, pursuant to Resolution No. 98-242, adopted March 10, 1998, Resolution No. 99-197, adopted March 23, 1999 and Resolution No. 05-0117, adopted February 24, 2005, the City Commission previously designated certain areas within the City of Miami ("City") to be Brownfields Areas, which were determined to have redevelopment potential that might be limited by actual or perceived environmental issues; and WHEREAS, after further analyses, other areas within the City were identified that have a critical need for rehabilitation and redevelopment, and meet the following designation criteria, in accordance with The Brownsfield Redevelopment Act, Section 376.80(2)(a), Florida Statutes, for Brownfield program administration processes; (1) the proposed Brownfields Area warrants economic development and has a reasonable potential for such activities; (2) the proposed Brownfields Area represents a reasonably focused approach and is not overly large in geographic coverage; (3) the proposed Brownfields Area has potential to interest the private sector in participating in rehabilitation; and (4) the proposed Brownfields Area contains sites or parts of sites suitable for limited recreational open space, cultural, or historical preservation purposes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 Printed On: 9/18/2006 File Number: 06-01418 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission approves expanding the boundaries of the City Brownfield Areas to include the augmented (01/01/06) Enterprise Zone as illustrated and described in "Exhibit A," attached and incorporated. Section 3. In accordance with The Brownfields Redevelopment Act, Section 376.80(2)(a), Florida Statutes, for Brownfield program administration processes, the City Manager is authorized{1} to notify the Florida Department of Environmental Protection and the Miami -Dade County Department of Environmental Resources Management of the City's decision to expand the City of Miami Brownfield Areas to include the Enterprise Zone as illustrated and described in "Exhibit A," attached and incorporated. Section 4. The City Manager is authorized{1} to undertake any other necessary related procedures, notices, and requirements for said designation, for said purposes. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. FERNANDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
