HomeMy WebLinkAboutR-06-0559City of Miami Legislation Resolution: R-06-0559 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01648 Final Action Date: 9/28/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE MAYOR AND THE CITY CLERK TO APPROVE THE RELEASE OF A UNITY OF TITLE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 119 SOUTHWEST 6TH AVENUE AND 574 SOUTHWEST 1ST STREET, MIAMI, FLORIDA. WHEREAS, the property owner of the properties located at 119 Southwest 6th Avenue and 574 Southwest 1st Street, Miami, Florida, wishes to be released from a recorded Unity of Title Agreement and to record a Declaration of Restrictive Covenants in lieu of the Unity of Title, as hereinafter set forth; and WHEREAS, this Unity of Title provides that it is to be released by the signatures of the Mayor and City Clerk, who are not the City of Miami ("City") officials who normally release a Unity of Title in the City; and WHEREAS, the City Commission, after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City and its inhabitants to allow the release of the Unity of Title Agreement as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Mayor and the City Clerk, of the City of Miami are authorized{1} to approve the release of a Unity of Title Agreement, in substantially the attached form, for the properties located at approximately 119 Southwest 6th Avenue and 574 Southwest 1st Street, Miami, Florida, allowing for the execution of a Declaration of Restrictive Covenants -in -lieu of Unity of Title instead which will be in substantially the attached form and to comply with the applicable provisions of the Zoning Ordinance. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
