HomeMy WebLinkAboutPre-Legislation 2City of Miami Legislation Resolution: R-04-4132 City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.rniami.fl.us File Number: 04-00144 Final Action Date:3/11/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND THE VILLAGE OF KEY BISCAYNE ("VILLAGE"), TO PROVIDE FIRE RESCUE, AUTOMATIC AID AND ANCILLARY SERVICES TO THE ' VILLAGE, FOR A PERIOD OF FIVE YEARS, COMMENCING APRIL 1, 2004 THROUGH MARCH 31, 2009. WHEREAS, pursuant to Resolution No. 98-555, adopted on June 9, 1998, the Village of Key Biscayne ("Village") and the City of Miami ("City") entered into an Agreement to provide fire rescue, automatic aid and ancillary services for the Village for a period of five years commencing October 1,1998 through September 30, 2003; and WHEREAS, pursuant to Resolution No. 03-1053, adopted on September 25, 2003, the City entered into a First Amendment Agreement with the Village dated September 25, 2003, to extend the contract on a month -to -month basis, not to exceed six months, from October 1, 2003 through March 31, 2004, to continue providing such services for the Village while the City's Department of Fire -Rescue negotiated a new contract; and WHEREAS, the City and the Village have found this to be a mutually beneficial relationship, and both parties have met all obligations of the previous contract; and WHEREAS, it is necessary to extend said -Agreement for a period of five years commencing April 1, 2004, to engage the City to implement such services on a contractual basis until such time as this Agreement may be cancelled by either party in the manner provided for; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, between the City and the Village, to provide fire rescue, automatic aid and ancillary services to the Village, for a period of five years commencing April 1, 2004 through March 31, 2009. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} City of Miami Page 1 of 2 Printed On: 4/16/2004 File Number: 04-00144 Enactment Number: R-04-0132 Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. if the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
