A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO PURCHASE, IN ACCORDANCE WITH
THE AGREEMENT DATED APRIL 1, 2004, BETWEEN THE CITY OF MIAMI AND
THE VILLAGE OF KEY BISCAYNE, ATTACHED, SECTION VIII, "RIGHT OF FIRST
REFUSAL," TWO (2) RESCUE TRUCKS, FOR THE DEPARTMENT OF
FIRE -RESCUE, IN AN AMOUNT NOT TO EXCEED $32,500 EACH, FOR A TOTAL
AMOUNT OF $65,000; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENT
PROJECT NO. 311850.026132.4.193.
WHEREAS, the City of Miami ("City") entered into an Agreement, dated April 1, 2004, with the
Village of Key Biscayne that addresses various inter -departmental issues ("Agreement"); and
WHEREAS, Section VIII of the Agreement, "Right of First Refusal," provides the City with the right
of first refusal to purchase any Key Biscayne Fire Rescue Department vehicle which Key Biscayne
wishes to sell; and
WHEREAS, two (2) rescue trucks are available for purchase from the Village of Key Biscayne; and
WHEREAS, two (2) appraisals of those vehicles have been obtained to assure fair market value;
and
WHEREAS, the City wishes to exercise its right of first refusal to purchase the two (2) rescue
vehicles from the Village of Key Biscayne to supplement its fleet;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section,
Section 2. The City Manager is authorized{1} to purchase, in accordance with the Agreement,
attached, Section VIII, "Right of First Refusal," two (2) rescue trucks, for the Department of
Fire -Rescue, in an amount not to exceed $32,500 each, for a total amount of $65,000, with funds
allocated from Capital Improvement Project No. 311850.026132.4.193.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor {2}.

Footnotes;
{1} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
