HomeMy WebLinkAboutR-06-0526City of Miami Legislation Resolution: R-06-0526 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01448 Final Action Date: 9/12/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION AMENDING THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FUND POLICIES FOR SINGLE FAMILY REHABILITATION PROGRAM AND THE REPLACEMENT HOME PROGRAM TO INCLUDE WAIVING INSURANCE REQUIREMENT FOR ELIGIBLE ELDERLY PERSONS PARTICIPATING IN SAID PROGRAMS. WHEREAS, the City of Miami's ("City's) current Single Family Rehabilitation Program policy and the Replacement Home Program requires the homeowner to carry the appropriate homeowners insurance; and WHEREAS, due to many of the properties that qualify for said programs are older housing stock that have no mortgage, and many of these homeowners do not carry the required property insurance and for those that do, the limits are very low; and WHEREAS, based on numerous applications the City has received, many of the elderly homeowners, living on limited fixed incomes, are unable to pay for the cost of insurance, thereby disqualifying them from said programs; and WHEREAS, the Administration is recommending amending the current policy to include waiving insurance requirements for eligible elderly persons participating in said programs; and WHEREAS, the United States Department of Housing and Urban Development regulation 24 CFR 891.205 defines an elderly person as an individual who is 62 years of age or older; and WHEREAS, for purposes of said programs, an eligible elderly person would be defined as an individual of at least 62 years of age, living on a fixed income and meeting the income eligibility requirement (120% area median income); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Community Development Block Grant Program fund policies for Single Family Rehabilitation Program and the Replacement Home Program are amended to include waiving the insurance requirement for eligible elderly persons participating in said programs. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
