HomeMy WebLinkAboutR-06-0515City of Miami Legislation Resolution: R-06-0515 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01499 Final Action Date: 9/12/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING THE FINDINGS OF THE EVALUATION COMMITTEE, PURSUANT TO REQUEST FOR LETTERS OF INTEREST NO. 03-04-071, THAT THE MOST QUALIFIED FIRM TO PROVIDE CONCESSION SERVICES AT THE MIAMI POLICE HEADQUARTERS BUILDING, FOR THE DEPARTMENT OF POLICE, IS LOPETEGUI, INC.; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONCESSION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH LOPETEGUI, INC., RETROACTIVELY AS OF JULY 18, 2004 THROUGH JULY 18, 2006, FOR THE BASED TERM, INCLUDING A ONE-YEAR EXTENSION SCHEDULED TO EXPIRE ON JULY 18, 2007, WITH THE OPTION TO EXTEND FOR TWO (2) ONE-YEAR PERIODS. WHEREAS, a Request for Letters of Interest ("RFLI") was issued on March 23, 2004, for the provision of concession services at the Miami Police Headquarters Building; and WHEREAS, an Evaluation Committee, appointed by the City Manager, reviewed and evaluated the proposal of Lopetegui, Inc., and Lopetegui, Inc., was selected to provide such services; and WHEREAS, an Agreement with Lopetegui, Inc., effective from July 18, 2004 through July 18, 2006, with up to three (3) one (1) year extensions was never executed; and WHEREAS, Lopetegui, Inc., has performed its duties pursuant to the proposed Agreement and the Department of Police is requesting the City Commission to accept the recommendation of the City Manager to approve the Agreement retroactively and to approve a one (1) year extension until July 18, 2007; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section. 2. The recommendation of the City Manager approving the findings of the Evaluation Committee, pursuant to RFLI No. 03-04-071, that the firm most qualified to provide concession services at the Miami Police Headquarters Building, for the Department of Police, is Lopetegui, Inc., is accepted. Section 3. The City Manager is authorized{1} to execute a Concession Agreement, in substantially the attached form, with Lopetegui, Inc., retroactively as of July 18, 2004 through July 18, 2006, for the based term, including a one-year extension scheduled to expire on July 18, 2007, with the option to extend for two (2) one-year periods. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
