A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR -FIFTHS (4/STHS)
AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES
AND APPROVING THE PROCUREMENT OF TWO (2) TRAILERS FOR THE
DEPARTMENT OF FIRE -RESCUE, FOR FIRE STATIONS 13 AND 14 FROM GE
CAPITAL MODULAR SPACE, IN AN AMOUNT NOT TO EXCEED $134,912;
AUTHORIZING SAID PURCHASES ON AN AS -NEEDED BASIS, SUBJECT TO THE
RECEIPT OF A BILL OF SALE ABSOLUTE, FOR THE TRAILERS AND THE
AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED.
WHEREAS, the Department of Fire -Rescue has been leasing trailers from GE Capital Modular
Space since July 2003; and
WHEREAS, the contract expired in June, 2006; and
WHEREAS, to date, the Department of Fire -Rescue did a cost analysis comparing lease versus
purchase and the analysis supports that it is most practicable and advantageous to purchase the two
(2) trailers from GE Modular Space; and
WHEREAS, funds for said service are subject to the availability of funds and Budgetary approval
at the time of need; and
WHEREAS, the City Manager and Fire Chief jointly recommend that the requirements for formal
competitive sealed bidding procedures be waived as not being practicable or advantageous to the
City of Miami ("City") in this instance and the procurement of the above trailers as specified be
approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA;
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's finding of waiving the requirements for competitive sealed bidding procedures, is ratified,
approved and confirmed, and the procurement of two (2) trailers form GE Capital Modular Space, the
most advantageous provider for said purchase, for the Department of Fire -Rescue, is hereby ratified,
approved, and confirmed, at a cost not to exceed $134,912, subject to the availability of funds and
Budgetary approval at the time of need.
Section 3. The City Manager and/or the Fire Chief are authorized{1} to accept a bill of sale

absolute conveying free and clear title to the City of the two (2) trailers. Such document(s) shall be in
a form acceptable to the City Attorney.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
