A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS),
GRANTING AN EXTENSION, UNTIL SEPTEMBER 30, 2006, TO RAFAEL
HERNANDEZ HOUSING AND ECONOMIC DEVELOPMENT CORPORATION TO
OBTAIN THE RECUIRED.CERTIFICATE OF OCCUPANCY AND SELL ONE(1)
NEW SINGLE FAMILY HOME AT 3290 NORTHWEST 9 COURT,,MIAMI,
FLORIDA, TO A OUALIFIED LOWIMODERATE INCOME FAMILY; STATING THE
INTENTION OF THE CITY COMMISSION RELATED TO THE CONVEYANCE OF
TITLE; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY
DOCUMENT(S) FOR SAID PURPOSE.
WHEREAS, Rafael Hernandez Housing and Economic Development Corporation ("RHHEO") was
designated by the Miami City Commission to construct single family homes on certain parcels,
formerly owned by the City of Miami ("City"), in the Aliapattah neighborhood; and
WHEREAS, RHHED has completed and sold the single-family homes located at 3,53 Northwest
11 Court, 788 Northwest 35 Street, 229 Northwest 30 Street and 3300 Northwest '9 Court, Miami,
Florida; and
WHEREAS, pursuant to Resolution No. 06-0276, adopted May 11, 2006, the City Commission
authorized the extension until June 2, 2006, to RHHED to construct and sell one 1) new single family
home at 3290 Northwest 9 Court, Miami, Florida; and
WHEREAS, due to issues related to the water connection, a certificate of occupancy has not been
obtained for the newsingle family home at 3290 Northwest 9 Court, Miami, Florida; and
WHEREAS, -RH4 ED has requested an extension to September 30, 2006, of the deadline to obtain
the required certificate of occupancy and to sell such home; and
WHEREAS, all other terms and conditions of the construction loan to RHI'IED will remain the
same;
NOW, THEREFORE, BE IT RESOLVED 8Y THE COMMISSION OF THE CITY OFMIAMI,
FLOR IDA :
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. An extension to September 30, 2006, for RHHED to obtain the required certificate of
occupancy and sale to a qualified low/moderate income family, of the new single family home located
at 3290 Northwest 9 Court, Miami, Florida, is authorized.
Section 3. it is in the intention of the City Commission that titre to the parcels conveyed by the City

to RHHED, described in Exhibit ''A," attached and incorporated, shall be deemed to have -remained in
RHHED from the date of conveyance. that the .extension of time granted herein shalWWe deemed tc
have been made onorbefore December 31, 2004, and that the extension of time granted herein shall
be deemed to apply to the construction and sale of all such parcels.
Section 4. The City Manager is authorized {1) to execute ail necessary docurner s#orsaid
purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.(2)

{1) The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2) if the Mayor does not sign this Resolution. it shall become effective at the er d-of en ($0) calendar
days from the date it was passed and adopted. if the -Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
