HomeMy WebLinkAboutSpecial ConditionsSection 3.0 Special Conditions 3.01 Manufacturer's Certification of Dealer: Bids submitted by other than the equipment manufacturer, shall include a certification executed by the manufacturer, stating that the bidder is an authorized dealer/representative of the manufacturer. Dealer agreements shall not be accepted in lieu of manufacturer certification. Bids requiring manufacturer certification will not be considered if certification is not submitted with the bid. 3.02 Notice to Provider: The employment of unauthorized aliens by any Provider is considered a violation of Section 247A(e) of the Immigration and Nationalization Act. If the Provider knowingly employs unauthorized aliens, such violation shall be cause for unilateral cancellation of the Contract. 3.03 Price Lists: The Bidders will submit their current published Manufacturer's Standard Price List and a Price List with models, descriptions, discounts and the net discounted prices from the submitted published current Manufacturer's Standard Price List. Any subsequent revisions to this Price List shall be submitted in the same format to the Department, for review and approval prior to implementation. Discounted prices shall be firm net delivered price to the ordering agency. A revised price list may be submitted to the State Purchasing with the State reserving the right to accept or reject. All requests for acceptance of revised price lists must be substantiated by written evidence that they are the result of general industry❑wide changes. Any requests for price increases must be submitted directly by the contractor — not a second party. 3.04 Quantity Discounts: Provider is urged to offer additional discounts for delivery of large single orders to one location in the space provided in Section 4.0. Such discounts will not be considered in evaluation of bid. 3.05 Parts, Accessories and Attachments: For each manufacturer brand bid, Bidders shall submit price list(s) with a percentage discount range for parts, accessories and attachments. This discount must be bid in order for the Bidder to be deemed responsive; however this will not be part of the basis of award. Price Sheets are included in Section 4.0. Customers will have the option to purchase parts, accessories and attachments from the Contract or from other providers. 3.06 Federal and State Standards: It is the intent that all specifications are in full and complete compliance with all Federal and State of Florida laws and regulations that apply to the type and class of Equipment being provided. This includes, but is not limited to, Federal Motor Equipment Safety Standards (FMVSS), Occupational Safety and Health Administration (OSHA), Environmental Protection Agency (EPA) Standards, and Florida requirements for external noise control that apply to the type and class Equipments being provided. If an apparent conflict exists, the Contractor must contact the Department immediately. In addition, any Federal and State legislation which should become effective regarding equipment safety shall immediately become a part of this Contract. Contractor shall have the option to meet or exceed 22 any such safety standard or cancel its portion of the Contract by providing thirty (30) days written notice to the Department. Models may become obsolete during the course of a year when new legislation or standards become effective. Those models will no longer be available for purchase. Replacement models meeting new required standards shall immediately become part of the Contract. 3.07 Defect Remedy: When Boat Motors require service or adjustments upon delivery the Provider shall either remedy the defect or be responsible for reimbursing the manufacturer's local authorized dealer or others to remedy the defect. Such service or adjustments shall be initiated by the Provider within forty eight (48) hours (not including weekends and holidays) after notification by the Eligible Customer. Delivery will not be considered complete until all service and/or adjustments are satisfactory and the equipment is re - delivered. The provisions of the delivery paragraph shall remain in effect until the re -delivery is accomplished. The cost of any transportation required shall be the responsibility of the Provider until the equipment is satisfactorily accepted by the Eligible Customer. 3.08 Manufacturer's Test Motors: The State of Florida is home to many different marine environments for all types of boating applications. Our waterways are ideal for testing Boat Motors for Manufacturers. If, a represented Manufacturer is interested in testing their motors through use of this contract, then contact one of the State's Eligible Customers for arrangement of these test projects. 3.09 Sales Summary Report: The Provider shall furnish the Department a detailed Sales Summary Report at the end of each Contract Quarter. The Sales Summary Report shall include State Contract numbers, Provider's name and the total of each commodity by State and Political Subdivision listed on the price sheet. Failure to provide this information, including no sales, within thirty (30) calendar days following the end of each Contract Quarter may result in the Provider being found in default. By submission of these Sales Summary reports and corresponding Transaction Fee Report and payment, the Provider is certifying their correctness. All such reports and fee deposits shall be subject to audit by the State of Florida. 3.10 Warranty: The Motors shall be covered under the manufacturer's standard warranty for commercial applications and include all manufacturer's standard equipment for both freshwater and saltwater use. Warranties shall be a minimum of one (I) year, from the date the unit is placed into service. All bidders are to indicate if they offer any additional warranties. A copy of the manufacturer's warranty shall be provided with each unit delivered under this contract. 23
