HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www,miamigov.com File Number: 06-0I480 Final Action Date: A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING THE CITY MANAGER TO EXECUTE A UNITY OF TITLE RESTRICTING THE USE OF TWELVE CITY -OWNED PARCELS OF LAND, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID UNITY OF TITLE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID PURPOSE. WHEREAS, Resolution No. 01-1029, adopted September 25, 2001, directed the City Manager to take all steps necessary to initiate and implement the development of a park in the Little Haiti area ("Park Project"); and WHEREAS, the boundaries for the Park Project as established by the City Commission are to be from Northeast 59th Street to Northeast 64th Terrace between Northeast 2nd Avenue and Northeast 4th Avenue, Miami, Florida; and WHEREAS, the properties located at 254 NE 59 Terrace, 247 NE 59th Street, 212 NE 59Th Terrace, 211 NE 59th Street, 215 NE 59th Street, 245 NE 59th Street, 253 NE 59th Terrace, 255 NE 59th Terrace, 263 NE 59 Terrace, 265-71 NE Terrace, 299 N.E. 59th Terrace, and 303 NE 59th Terrace, Miami, Florida ("Properties"), are within the Park Project boundaries and were included in the land assembly required for the purpose of constructing the cultural component of the Little Haiti Park Project, entitled Little Haiti Cultural Campus; and WHEREAS, pursuant to Resolution Nos. 04-0399, 04-0104, 03-1203, 04-0068, 05-0388 03-472, 03-473, 03-471, 03-474, and 03-470 the Commission authorized the acquisition of said Properties; and WHEREAS, the City of Miami ("City") is now owner of the Properties and has established a capital improvement project to design and construct the Little Haiti Cultural Campus, to be located on the Properties; and WHEREAS, said project has been incorporated into the City's Capital Improvement Program Plan as Project No. B-30295, entitled "Little Haiti Cultural Campus" ("Project"); and WHEREAS, pursuant to Resolution No. 04-0786, adopted December 9, 2004, the City determined that the Project is best implemented using a Construction -Management at risk method, with Pirtle Construction Company, Inc. ("Pirtle") serving as the lead contractor and the design firm of Zyschovich Architects as the lead consultant for the design team; and WHEREAS, the firms are responsible for a scope of work consisting of the design and construction of a 250-seat theater with dance and drama rehearsal halls, a Community Center with an art gallery, workrooms, community meeting rooms, and related sitework; and WHEREAS, pursuant to Section 910 of Zoning Ordinance 11000, in order to obtain the necessary City of Miami Page 1 of 2 Printed On: 8/31/2006 File Number: 06-01480 approvals from the Planning Department, Zoning Department and the Building Department ("Departments"), the execution of a Unity of Title is required and shall be filed as a permanent part of public property records in the Miami -Dade County courthouse. WHEREAS, execution of the attached Unity of Title will satisfy the Departments requirements by placing limitations on the land encompassing the building site; and WHEREAS, the Unity of Title shall remain in full force and effect until such time as the same may be released in writing by the Director of the Planning Department and/or the Zoning Director; NOW, THEREFORE, BE !T RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized 1 to execute a Unity of Title, in substantially the attached form, restricting the use of twelve city -owned parcels of land with terms and conditions as more particularly set forth in said Unity of Title.
