HomeMy WebLinkAboutR-06-0489City of Miami Legislation Resolution: R-06-0489 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01475 Final Action Date: 9/12/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF CHILDREN AND FAMILIES, A STATE OF FLORIDA GOVERNMENT ENTITY, FOR THE USE OF THE ORANGE BOWL STADIUM, ON AN AS -NEEDED BASIS AND SUBJECT TO AVAILABILITY, THROUGH DECEMBER 31, 2007, FOR THE PURPOSE OF PROVIDING A DISASTER FOOD STAMP DISTRIBUTION CENTER FOR THE "FOOD FOR FLORIDA" PROGRAM IN THE EVENTA STORM HITS THE SOUTH FLORIDA AREA; FURTHER PROVIDING FOR A WAIVER OF THE BASIC USE FEE ASSOCIATED WITH SAID USE. WHEREAS, following Hurricane Wilma last year, the City of Miami ("City") agreed to allow the Department of Children and Families ("DCF") to utilize the Orange Bowl Stadium ("Stadium") as a Disaster Food Stamp Distribution Center, for the "Food for Florida" Program, at no cost; and WHEREAS, the "Food for Florida" Program attracted an estimated 74,000 applicants over a five-day application period at the Stadium allowing for some temporary financial relief to those citizens suffering from financial strain caused by the hurricanes; and WHEREAS, the City and the State of Florida ("State") and DCF would like to enter into a Use Agreement prior to an emergency situation occurring in order to provide for the State's use of the Stadium on an as -needed basis and subject to availability; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Use Agreement, in substantially the attached form, with DCF, a State government entity, to provide for DCF's use of the Stadium, on an as- needed basis and subject to availability, through December 31, 2007, for the purpose of providing a disaster food stamp distribution center for the "Food for Florida" Program in the event a storm hits the South Florida area and a waiver of the basic use fee associated with said use, is waived. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
