HomeMy WebLinkAboutR-06-0488City of Miami Legislation Resolution: R-06-0488 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01454 Final Action Date: 9/12/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT FROM THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION ("FDOT"), THE FOLLOWING THREE PARCELS OF LAND: PARCEL 1 CONTAINING APPROXIMATELY 2,862 SQUARE FEET, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; PARCEL 2 CONTAINING APPROXIMATELY 992 SQUARE FEET, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "B," ATTACHED AND INCORPORATED; AND PARCEL 3 CONTAINING APPROXIMATELY 259 SQUARE FEET, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "C," ATTACHED AND INCORPORATED, OF FDOT PROPERTY LOCATED IN THE AREA OF SOUTHWEST 5TH STREET AND 3RD AVENUE, MIAMI, FLORIDA , BY QUITCLAIM DEED, WITH A PUBLIC PURPOSE REVERTER PROVISION, IN SUBSTANTIALLY THE ATTACHED FORM, TO BE USED IN CONNECTION WITH THE DEVELOPMENT OF JOSE MARTI PARK; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS WHICH ARE NECESSARY TO EFFECTUATE SAID ACQUISITION. WHEREAS, there are three parcels of land, as described in Exhibits "A," "B" and "C," attached and incorporated (collectively the "Properties"); and WHEREAS, said Properties are no longer required for state highway purposes by the State of Florida Department of Transportation ("FDOT"); and WHEREAS, the City of Miami ("City") needs, and has requested FDOT to convey the Properties; and WHEREAS, FDOT is willing to convey the Properties to the City at no charge but has required a public purpose reverter provision; and WHEREAS, it is necessary that said Properties be accepted by the City in order to enable the construction of the improvements for Jose Marti Park which will serve the best interest of the general welfare of the City and its inhabitants; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to accept the conveyance of the real Properties, in the area of Southwest 5th Street and 3rd Avenue, Miami, Florida, as legally described in Exhibits "A," "B" and "C," attached and incorporated, from FDOT, by Quitclaim Deed, with a public purpose reverter City of Miami Page 1 of 2 File Id: 06-01454 (Version: 2) Printed On: 2/14/2017 File Number: 06-01454 Enactment Number: R-06-0488 provision, in substantially the attached form, to be used in connection with the development of Jose Marti Park. Section 3. The City Manager is further authorized{1} to execute all documents which are necessary to effectuate said acquisition. Section 4.This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
