City of Miami Legislation Resolution Enactment Number: R-24-0164 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15915 Final Action Date:4/25/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION ELECTING TO NOT REAPPOINT THEODORE GUBA AS THE INDEPENDENT AUDITOR GENERAL FOR A FOUR (4) YEAR TERM AND INSTEAD APPOINTING THEODORE GUBA ON A MONTH -TO -MONTH BASIS TO SERVE AS INTERIM INDEPENDENT AUDITOR GENERAL UNTIL SUCH TIME AS THE CHARTER AMENDMENT VOTE ELIMINATING THE OFFICE OF THE INDEPENDENT AUDITOR GENERAL. WHEREAS, by Resolution No. R-20-0009 adopted April 9, 2020, the City Commission reappointed Theodore Guba ("Guba") as the Independent Auditor General of the City of Miami, Florida ("IAG") for a four (4) year term as IAG effective May 7, 2020; and WHERAS, Guba's four (4) year term ends May 7, 2024; and WHEREAS, the City Commission desires the citizens to vote on a Charter amendment that would eliminate the Office of the IAG; and WHEREAS, because of the Charter amendment, the City Commission does not wish to reappoint Guba for a four (4) year term; and WHEREAS, the City Commission wishes to appoint Guba as the Interim IAG on a month -to -month basis until such time the citizens vote on the Charter amendment and/or further action of the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as is fully set forth in this Section. Section 2. The City Commission hereby elects not to reappoint Guba for a four (4) year term as the IAG. Section 3. The City Commission instead appoints Guba to serve as an Interim IAG on a month -to -month basis until such time as the electors of the City approve the Charter amendment eliminating the Office of the IAG, or in the event that the electors of the City reject the Charter amendment, then until such time as the City Commission appoints an IAG, whichever occurs first. Section 4. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: Pursuant to the resolution, this item became effective immediately upon adoption by the Commission.
