A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE TWO
TEMPORARY EVENT LIMITATION PER YEAR FOR THE PRIVATE PROPERTY
LOCATED AT 75 NORTHEAST 39 STREET, MIAMI, FLORIDA PURSUANT TO
CHAPTER 62/ARTICLE XIII/DIVISION 1/SECTION 62-521(B)(4) OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "PLANNING AND
ZONING/PLANNING AND ZONING APPROVAL FOR TEMPORARY USES AND
OCCUPANCIES; PERMIT REQUIRED/TEMPORARY EVENT PERMITS/TEMPORARY
EVENTS IN GENERAL," TO ALLOW FOR RESERVE PADEL MIAMI EVENTS TO BE
HELD FROM MAY 23, 2024 THROUGH DECEMBER 31, 2024.
WHEREAS, pursuant to Section 62-521(b)(3) of the Code of the City of Miami, Florida,
as amended ("City Code"), provides, "[n]o more than two temporary events shall be permitted,
each for a maximum duration of two weeks, on private property per year. No more than ten
temporary events shall be permitted, each for a maximum duration of two weeks, on public
property per year, unless approved by the City Commission"; and
WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events in
a year can be waived upon affirmative vote of the City Commission; and
WHEREAS, Reserve Padel ("Event") is holding events located at 75 Northeast 39 Street
("Event Site"), which is a privately owned property; and
WHEREAS, Reserve Padel has been hosting events, training lessons and competitions
in the City of Miami ("City") for the past several years; and
WHEREAS, the Event Site has already held events and has secured their TEP Number
SECO-24-02-723 with Building Permit Process number BD24004458001 which expires May 22,
2024; and
WHEREAS, in order to continue for the remainder of the planned Events, the Event
requires a City Commission waiver to continue the Event from July 14, 2024 through December
31, 2024; and
WHEREAS, the Event at the Event Site still require any further necessary permits to be
issued by the City to ensure life -safety and quality of life issues and appropriate conditions may
be imposed on each permit; and
WHEREAS, the Event at the Event Site is be beneficial to the City's residents and
visitors; and
WHEREAS, pursuant to Section 2-33(f) of the Code of the City of Miami, Florida, as
amended, the Miami City Commission, by a majority vote, deems this Resolution to be of an
emergency nature;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Temporary Events
in General," the two (2) temporary event per year per private property limitation is hereby
waived to allow Event at the Event Site from May 23, 2024, through December 31, 2024.
Section 3. This Resolution does not waive any other requirements of the City Code,
including but not limited to, noise restrictions, applicable fees, inspections, and permits.
Section 4. This Resolution shall become effective immediately upon its adoption.
