Final Action Date:
AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING ARTICLE 25,
SECTION 2502 OF ZONING ORDINANCE 11000, AS AMENDED, IN ORDER TO
EXPAND THE DEFINITION OF A DWELLING UNIT TO ACCOMMODATE
STUDENT HOUSING WITHIN ANY DISTRICT WHICH PERMITS MULTIFAMILY
HOUSING; TO AMEND THE DEFINITION OF FAMILY TO EXCLUDE STUDENT
HOUSING; AND TO ADD A DEFINITION FOR STUDENT HOUSING USE;
CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting of May 3, 2006, Item No. 6,
following an advertised public hearing, adopted Resolution No. PAB 06-046 by a vote of nine to zero
(9-0), recommending APPROVAL of amending Zoning Ordinance No. 11000, as amended, as
hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of this matter deems it advisable
and in the best interest of the general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000, as amended, so as to encourage institutions of higher learning to locate in the
City of Miami as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Mia
Florida, is hereby amended by amending the text of said Ordinance as follows:{1}
"ARTICLE 25. Definitions."
Sec. 2502. Specific Definitions.
Dwelling unit. One (1) or more interconnected rooms with a single kitchen facility and sanitary
facilities provided within the dwelling unit for the exclusive use of a single family maintaining a
household or student housing. As defined by this ordinance, and except for purposes of federally
subsidized housing, minimal dwelling unit size shall be as follows: efficiency - four hundred (400)
square feet, one -bedroom - five hundred fifty (550) square feet, two -bedroom - six hundred fifty (650)
square feet. Any student housing use must provide at least one hundred fifty (150) square feet per
student in each dwelling unit.

Family. A family is one (1) or more persons occupying a single dwelling or lodging unit, provided
that, unless all members are related by blood, marriage, or adoption, no such family shall contain over
three (3) persons (including servants). A family may also include a group of not more than eight (8)
foster children, in addition to the foster parents' natural children, provided that such home is approved
by appropriate state and/or local agencies. The term "family" shall not be construed to mean fraternity,
sorority, dub, or institutional group, or student housing as defined herein.

Student Housing. Student Housing is permitted within multifamily dwellings and may include up to
six (6) unrelated persons. Student Housing is only permitted in conjunction with an agreement with a
post -secondary/ educational institution.
Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict
with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.{2}

{2}This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
