A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING THE
RECOMMENDATION OF THE COCONUT GROVE BUSINESS IMPROVEMENT
COMMITTEE, PURSUANT TO SECTION 54-343(5) OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED, AUTHORIZING THE DEPARTMENT OF
OFF-STREET PARKING ("DOSP") TO APPORTION AND TO WAIVE A PART OF
THE SUPPLEMENTARY USER FEE FOR THE 2006 GOOMBAY FESTIVAL, ONLY
A PORTION OF WHICH WAS HELD IN THE COCONUT GROVE SPECIAL
EVENTS DISTRICT, MIAMI, FLORIDA; AUTHORIZING AND DIRECTING DOSP
TO EXECUTE ANY NECESSARY DOCUMENTS FOR SAID PURPOSE.
WHEREAS, Section 54-343 of the Code of the City of Miami, as amended ("City Code"),
provides for a supplementary user fee to be required for special events occurring in the Coconut
Grove Special Events District and for such supplementary user fee to be paid to the Department of
Off -Street Parking ("DOSP") to deposit into the Coconut Grove Special Events District Fund; and
WHEREAS, pursuant to Section 54-343(5) of the City Code, the Coconut Grove Business
Improvement Committee ("BIC") on July 18, 2006, voted to recommend to the Miami City Commission
to apportion and to waive a part of the supplementary user fee for the 2006 Goombay Festival, only a
portion of which was held in the Coconut Grove Special Events District, so that the amount to be paid
by the 2006 Goombay Festival to DOSP on behalf of the BIC shall be $4,308,83 instead of the full
supplementary user fee of $10,000;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The recommendation of the BIC, pursuant to Section 54-343(5) of the City Code,
authorizing DOSP to apportion and to waive a part of the supplementary user fee for the 2006
Goombay Festival, only a portion of which was held in the Coconut Grove Special Events District, is
accepted.
Section 3. DOSP is authorized and directed to execute any necessary documents for said
purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
