Subject: Resolution to approve Amendment No. 1 to the Civil Engineering for Storm Sewer/Road
Improvement/Dredging Projects Agreement ("Agreement") with Post, Buckley, Schuh, and Jernigan
(PBS&J) providing for additional services in order to comply with State mandates. The required services
will increase the agreement value by $158,932 for a total amount not to exceed $658,932.
Purpose of Item:
To authorize Amendment No. 1, to the existing agreement with PBS&J to perform additional water quality
monitoring services for the development of Wagner Creek Total Maximum Daily Loads ("TMDL") - a new
requirement to maintain compliance with Florida Department of Environmental Protection ("DEP")
National Pollution Discharge Elimination System Permit ("Permit") stipulations. This is the first year these
requirements are in place and few firms have experience in this area. One firm, PBS&J is currently under
contract with the City. The additional services will result in an increase to the contract amount by $158,932,
for a total contract amount not to exceed $658,932. The alternate method of procuring these services would
be through a competitive process, however there is insufficient time to se licit new proposals and meet the
December deadline.
Background Information:
Pursuant to City Code No. 18-87, the City issued RFQ No. 02-03-163 on 5/21/03 for the provision of civil
engineering services for Storm Sewer/Road Improvement/Dredging Projects on a continuing basis for
miscellaneous services. PBS&J's proposal, was selected as one of the most qualified; consequently, an
Agreement was executed on 1 /21 /05 for the provision of services related to the development of TMDLs for
Wagner Creek. A new type of water quality monitoring is now required and must be completed by the end
of the year to comply with Florida DEP Permit stipulations. These services are best provide by PBS&J
who has expertise in this area; however, the balance of $22,347 is not sufficient to cover the remaining
work. Therefore, it is necessary to increase the value by an amount not to exceed $158,932 from $500,000
to an amount not to exceed $658,932.
