HomeMy WebLinkAboutR-06-0413City of Miami Legislation Resolution: R-06-0413 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01140 Final Action Date: 7/13/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND AFTERLIFE SERVICES, INC., A FLORIDA CORPORATION D/B/A THE ATLANTIS REEF PROJECT, FOR THE USE OF 10,000 SQUARE FEET OF CITY -OWNED PROPERTY LOCATED AT 3501 RICKENBACKER CAUSEWAY, KNOWN AS MARINE STADIUM PARKING, MIAMI, FLORIDA, FOR USE AS A STAGING AREA FOR THE PURPOSE OF MAKING CONCRETE SLABS TO BE LOADED ONTO A BARGE TO CREATE THE ATLANTIS REEF PROJECT, WITH PAYMENT OF A USE FEE EQUAL TO $4,000, PER MONTH, PLUS APPLICABLE STATE OF FLORIDA USE TAX, WITH OTHER TERMS AND CONDITIONS MORE PARTICULARLY STATED IN THE AGREEMENT. WHEREAS, the City of Miami ("City") is the owner of the property located at 3501 Rickenbacker Causeway, Miami, Florida a/k/a Marine Stadium ("Property"); and WHEREAS, the AfterLife Services, Inc., d/b/a the Atlantis Reef Project ("Licensee") expressed interest in using a portion of the parking area in Marine Stadium for use as a staging area to create and load onto barges the concrete slabs that will comprise the base units of the Atlantis artificial reef structure; and WHEREAS, the Atlantis Reef Project will be an underwater recreational diving destination and resting place for cremated remains covering six (6) acres of sea floor, 3.5 miles off of Key Biscayne; and WHEREAS, the Licensee has obtained all required clearances from respective government agencies, including: the Miami -Dade County Department of Environmental Resource Management, Fish and Wildlife, Army Corps of Engineers, National Marine Fisheries Service, Florida Fish and Wildlife Conservation Commission, and the Florida Department of Environmental Protection; and WHEREAS, the City and the Licensee desire and intend to enter into a Revocable License Agreement ("Agreement") for said purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, between the City and the Licensee, for the use of 10,000 square feet of the City -owned Property, for use as a staging area for the purpose of making concrete slabs to be loaded City of Miami Page 1 of 2 File Id: 06-01140 (Version: 11 Printed On: 2/7/2017 File Number: 06-01140 Enactment Number: R-06-0413 onto a barge to create the Atlantis Reef Project, with payment of a use fee equal to $4,000, per month, plus applicable State of Florida Use Tax, with other terms and conditions more particularly stated in the Agreement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor {2}. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
