Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, the subject proposal for an amendment to the Zoning Atlas has been
reviewed as follows:
The request is to change the Zoning designation as follows:
The subject property is comprised of several lots bounded by NW Flagler Terrace on the
north, West Flagler Street on the south and NW 40th Avenue on the west (A complete legal
description is on file with the Hearing Boards Office); from R-1 "Single Family
Residential" and R-3 "Multifamily Medium -Density Residential" to C-1 "Restricted
Commercial",
The following findings have been made:
• It is found that the character of the southern edge of the block of is R-3 "Multifamily
Medium -Density Residential" residential and the northern edge of the block is R-1 "Single
Family Residential."
• It is found that a zoning change to C-1 "Restricted Commercial, at this location, may set a
negative precedent and create a "domino effect" in regards to zoning change applications for
the remainder of this block.
• It is found that the R-1 "Single Family Residential" and R-3 "Multifamily Medium -Density
Residential" designation allow a maximum density of 9 and 65 residential units per acre
respectively, and the requested C-1 "Restricted Commercial" designation will allow a
maximum density of 150 residential units per acre.
• It is found that the requested zoning change designation requires a change to the underlying
land use designation and therefore requires an amendment to the Future Land Use Map of the
Comprehensive Plan.
Based on these findings, the Planning Department is recommending denial of the
application as presented.
