FILE NO: 06-00356zc Pursuant to Article 4, Section 401 and Article 22 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal for an amendment to the Zoning Atlas has been reviewed as follows: The request is to change the Zoning designation as follows: Lots 1, in Block 1, DURHAM TERRACE SUBDIVISION, (44 - 55), from R-3 "Multifamily Medium -Density Residential" to C-1 "Restricted Commercial". The following findings have been made: • It is found that the subject property is under the same ownership as the lots immediately adjacent to the west, facing NW rh Street, designated C-1 "Restricted Commercial". • It is found that there is only one lot in this area with the R-3 "Multifamily Medium Density Residential" designation. • It is found that this petition to change the zoning designation is in order to have the same designation for all the property. • It is found that the requested change to C-1 "Restricted Commercial" will increase the possibility of the subject property being enhanced in a manner which will directly benefit the adjacent area. It is found that "Medium Density Multifamily Residential" categories allow 65 residential units per acre and the requested "Restricted Commercial" designation allows a maximum of 150 residential units per acre Based on these findings, the Planning Department is recommending approval of the application as presented.
