HomeMy WebLinkAboutAnalysisANALYSIS FOR ZONING CHANGE 27 & 29 NW 34th Terrace and 34 NW 35th Street FILE NO: 06-00409zc Pursuant to Article 4, Section 401 and Article 22 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for an amendment to the Zoning Atlas as follows: The request is to change the Zoning designation as follows: Lots 11 and Lots 26 through 28, Block 6, "WYNDWOOD PARK" (5 - 3), from R-2 "Two -Family Residential" and R-3 "Multifamily Medium -Density Residential" to C-2 "Liberal Commercial". The following findings have been made: • It is found that the subject properties are currently under the same ownership of the immediately adjacent lots to the east, facing North Miami Avenue, a major transportation corridor. • It is found that the frontages of the subject properties are on NW 35th Street and NW 36th Street, the character of these streets are residential. • It is found that to the east of above described properties the designation is C-2 "Liberal Commercial" zoning designation. It is also found that Midtown Miami is located directly across North Miami Court, to the east. • It is found that this petition is part of a Major Use Special Permit (MUSP) for a project named "MID TOWN PARK". • It is found that the Land Use designation for the subject properties is not Restricted Commercial, and requires a Land Use designation change as well. • It is found that the theoretical potential commercial activities created by this amendment will not be an intrusion into the existing residential neighborhood due to the fact that the project will provide a large landscaped park open to the public along with ground floor retail and live/work spaces which will activate the streets by engaging pedestrian activities. This project will also be able to provide and maintain a buffer to the existing neighborhood by allowing a proper transition in bulk and height from the nearby residential to the C-2 "Liberal Commercial" designation. Based on these findings, the Planning Department is recommending approval of the application as part of the Major Use Special Permit.
