HomeMy WebLinkAboutCC Variance AnalysisAnalysis for Variance for the HIAWATHA MUSP located at 3535 Hiawatha Avenue File No. 06-00436v Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for Variance as follows: Height Variance: Required - 50'-0" Proposed - 78'-4" Request to waive - 28'-4" In determining the appropriateness of the Variance for the proposed project the following findings have been made: • It is found that the proposed project will benefit the area on the block bounded by Hiawatha Street (to the northwest) and West Glencoe Street (to the northeast) and Biscayne Bay by creating new residential units. • It is found that the height variance requested is a result of the applicant trying to provide an enclosed surface parking at the ground level of the proposed eight (8) stories residential condo; however, there is no substantial hardship which limits reasonable use of the property. It is found that the requested height variance will have no adverse effects on the adjacent area and will not be injurious to the city or in conflict with the intent of the zoning district. Based on these findings, the Planning Department is recommending denial of the application as presented.
