Ganguzza offered the following resolution and moved its adoption Resolution: AFTER CONSIDERING THE FACTORS SET FORTH IN SECTION 1305 OF ORDINANCE NO. 11000, THE ZONING BOARD RECOMMENDED APPROVAL TO THE CITY COMMISSION OF THE SPECIAL EXCEPTION AS PART OF A MAJOR USE SPECIAL PERMIT FOR THE MIDTOWN PARK PROJECT AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO ALLOW A MULTIFAMILY STRUCTURE OF A DENSITY EQUAL TO R-4 OR HIGHER FOR THE PROPERTIES LOCATED AT APPROXIMATELY 3452-56 AND 3466 NORTH MIAMI AVENUE, 20 AND 34 NORTHWEST 35TH STREET AND 27 AND 29 NORTHWEST 34TH TERRACE„ LEGALLY DESCRIBED AS EXHIBIT "A" (HEREBY ATTACHED), PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; ZONED R-2 TWO-FAMILY RESIDENTIAL AND R-3 MULTIFAMILY MEDIUM -DENSITY RESIDENTIAL. THIS SPECIAL EXCEPTION WAS RECOMMENDED FOR APPROVAL WITH A TIME LIMITATION OF TWENTY-FOUR MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED, SUBJECT TO THE FOLLOWING CONDITIONS BY THE PLANNING DEPARTMENT: 1) THE APPLICANT SHALL PRESENT FINAL DESIGN DETAILS ON THE FACADES, INCLUDING COLOR, SIGNS, MATERIALS, SITE AND LANDSCAPE PLANS FOR REVIEW AND APPROVAL BY THE PLANNING DIRECTOR PRIOR TO THE ISSUANCE OF A BUILDING PERMIT AND THIS APPROVAL SHALL BE SUBJECT TO ALL ADDITIONAL CONDITIONS SPECIFIED IN THE FINAL DEVELOPMENT ORDER OF THE MAJOR USE SPECIAL PERMIT FOR THE PROJECT. Upon being seconded by Mr. Angel Urquiola, it is found that: • It is found that the proposed mixed -use development project will benefit the city by creating new housing opportunities for residents of the area as well as attracting new residents to the Upper Eastside area. • It is found that sufficient parking is provided to meet the foreseeable needs of the project. • It is found that the proposed layout provides adequate vehicular circulation. • It is found that with respect to all additional criteria as specified in Section 1305 of Zoning Ordinance 11000, the proposal has been reviewed and found to be adequate. the motion was passed and adopted by the following vote : Mr. Ron Cordon Yes Mr. Miguel Gabela Yes Mr. Joseph H.
