HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miamlfl.us File Number: 06-01013 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE USE OF THE PLAZA IN FRONT OF THE EXISTING PAVILION LOCATED IN THE NORTHEAST CORNER OF JUAN PABLO DUARTE PARK, IN THE CITY OF MIAMI ("CITY"), FOR THE INSTALLATION OF COMMEMORATIVE BRASS PLATES AND/OR HEAD BUSTS 1N HONOR OF COMMUNITY LEADERS WHO HAVE CONTRIBUTED TO THE CULTURAL AND ECONOMIC DEVELOPMENT OF THE DOMINICAN COMMUNITY IN MIAMI, FLORIDA; RESERVING THE RIGHT FOR THE CITY TO APPROVE IN ADVANCE THE NAMES OF THE INDIVIDUALS TO BE HONORED WITH A BRASS PLATE AND/OR HEAD BUST; AUTHORIZING THE CITY MANAGER TO EXECUTE A MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH FUNDACION PRO INTEGRACION DOMINICANA, INC., A FLORIDA NOT -FOR -PROFIT CORPORATION, FOR AN INITIAL TERM OF FIVE (5) YEARS, WITH ANY SUBSEQUENT TERM TO BE APPROVED BY THE CITY COMMISSION, FOR THE PURPOSE OF FUNDING THE INSTALLATION AND PROVIDING FOR THE MAINTENANCE OF THE NEW AND FUTURE COMMEMORATIVE BRASS PLATES AND/OR HEAD BUSTS TO BE INSTALLED BY SAID ORGANIZATION ON BEHALF OF THE COMMUNITY. WHEREAS, Juan Pablo Duarte Park, located in the City of Miami ("City"), has been an integral part of the Dominican community in the Allapattah neighborhood, and is used for festivals and as a focal meeting point; and WHEREAS, the pavilion at said park, located at the northeast corner of the park, contains several head busts and other commemorative brass plates in honor of Juan Pablo Duarte and other Dominican leaders; and WHEREAS, the Fundacion Pro Integracion Dominicana, Inc., has requested the use of the plaza in front of the pavilion to honor other leaders of the Dominican community; and WHEREAS, the City reserves the right to approve in advance, the names of the individuals, to be honored with a brass plate and/or head bust; and WHEREAS, the Fundacion Pro Integracion Dominicana, Inc., has agreed to fund the installation of said brass plates and/or head busts and to provide the maintenance of the related area and said brass plates and/or head busts; and WHEREAS, the City and the Fundacion Pro Integracion Dominicana, Inc., desire to enter into a Maintenance Agreement, the initial term of which would be five (5) years, with any subsequent extension or renewal of the Maintenance Agreement requiring City Commission approval; City of Miami Pagel of 2 Printed On: 6/12/2006 File Number: 06-01013 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The use of the plaza in front of the existing pavilion located in the northeast corner of Juan Pablo Duarte Park, in the City, for the installation of commemorative brass plates and/or head busts in honor of community leaders who have contributed to the cultural and economic development of the Dominican community in Miami, Florida, is approved. Section 3. The City reserves the right to approve in advance, the names of the individuals to be honored with a brass plate and/or head bust. Section 4. The City Manager is authorized{1} to execute a Maintenance Agreement, in substantially the attached form, with Fundacion Pro Integration Dominicana, Inc., a Florida not -for -profit corporation, for an initial term of five (5) years, with any subsequent term to be approved by the City Commission, for the purpose of funding the installation and providing for the maintenance of the new and future commemorative brass plates and/or head busts to be installed by said organization on behalf of the community. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPRO ED + S TO FORM AND CORRECTNESS JORG FERNANDEZ CITY A� ORN Y Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
