HomeMy WebLinkAboutR-06-0392City of Miami Legislation Resolution: R-06-0392 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01073 Final Action Date: 6/22/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO FENCE CITY OF MIAMI OWNED LOTS TO PREVENT SUCH LOTS FROM VIOLATING THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AS STATED HEREIN. WHEREAS, there exists a large number of City of Miami ("City") owned lots which are overgrown and which continually are strewn with garbage and waste, some or all of which is illegally dumped on them; and WHEREAS, these same City -owned lots are a haven for criminal activity because they are overgrown, with vegetation so high as to limit or obscure visibility; and WHEREAS, these lots constitute a threat to the health and safety of the citizens of the City; and WHEREAS, these City -owned lots have the potential of causing damage to the citizens of Miami if not properly maintained; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2 The City Manager is directed to provide that the appropriate department bring all City -owned lots into compliance. Section 3. The City Manager is authorized{1} to order that all City -owned lots which are not properly maintained or are not in compliance with the Code of the City of Miami, Florida, as amended, regarding lot maintenance and remaining free of solid waste, be secured with fencing and locked to prevent access to these lots. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miami Page 1 of 2 File Id: 06-01073 (Version: 21 Printed On: 2/3/2017 File Number: 06-01073 Enactment Number: R-06-0392 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
