The Agreement provides for the following: 1) Lessee to vacate and surrender the Property to Lessor on August 1, 2006; 2) Lessor shall pay Lessee the sum of $40,000.00 for relocation cost to vacate and surrender the Property; 3) upon full execution of this Agreement, Lessor shall pay Lessee the amount of $20,000.00; 4) and Lessor to pay Lessee the remaining $20,000.00 simultaneous with Lessee vacating and surrendering the Property of Lessor, with other terms and conditions as more particularly set forth in the Agreement. Chief/ .G 'JJ1 City Manager Page 1 of 2 AGENDA ITEM SUMMARY FORM Subject: Termination of Lease Agreement with River Village Development Limited Liability Corporation Background Information: On August 25, 2000, the City Manager executed a lease agreement between the City of Miami and Ms. Orielli Troia, Trustee under Revocable Trust Agreement, and owner of property located at 779 West Flagler Street, Miami Florida, to lease approximately 7601 square feet of property to be used for operation of the Office of Homeless Programs as office space, storage/warehouse and other related functions and a police substation. The City Manager executed this lease agreement as an emergency action to relocate the Office of Homeless Programs. The City Commission subsequently ratified, approved and confirmed the action of the City Manager in executing the lease. The Agreement provided for a two-year term, with renewal options of three (3) additional two-year terms, at an initial rent of $4,131.17 per month. On June 6, 2003, Ms. Orielli Troia sold and transferred her interest in the Property to River Village Development, LLC. The lease agreement is in its second option to renew period which ends August 24, 2006. River Village Development is interested in developing the property along with other properties it owns in the surrounding community. Administration has negotiated with the owner to pay the City the sum of $40,000.00 toward relocation costs in consideration for canceling the Lease and vacating and surrendering the Property on August 1, 2006. The Office of the Homeless Programs will relocate its administrative offices to the Overtown Shopping Center. Paee 2 of 2
