HomeMy WebLinkAboutR-06-0377City of Miami Legislation Resolution: R-06-0377 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01127 Final Action Date: 6/22/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION APPOINTING LINDA HASKINS, SUBJECT TO MEETING THE QUALIFICATIONS OF THE OFFICE, AS A MEMBER OF THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA, DISTRICT 2, TO FILL THE VACANCY CREATED BY THE SUSPENSION OF JOHNNY LEE WINTON TO SERVE UNTIL SUCH TIME AS THE RESULTS HAVE BEEN DECLARED AND CERTIFIED FOR AN ELECTION TO BE HELD ON NOVEMBER 7, 2006, OR UNTIL COMMISSIONER WINTON'S SUSPENSION MAY BE REVOKED PURSUANT TO SECTION 112.51(6), FLORIDA STATUTES (2005), WHICHEVER MAY OCCUR FIRST. WHEREAS, Johnny Lee Winton was serving as a City Commissioner for the City of Miami, Florida; and WHEREAS, on June 16, 2006, an information was filed charging Commissioner Winton with two counts of battery on a police officer and disorderly intoxication, violation of Sections 784.03(1), 784.07(2)(b) and 856.011(1), Florida Statutes, respectively; and WHEREAS, violation of Section 784.03(1), Florida Statutes, constitutes a misdemeanor of the first degree; violation of Section 784.07(2)(b), Florida Statutes, constitutes a felony of the third degree; and violation of Section 856.011(1), Florida Statutes, constitutes a misdemeanor of the second degree; and WHEREAS, it is in the best interests of the residents of the City of Miami, and the citizens of the State of Florida, that Commissioner Winton be immediately suspended from the public office, that he now holds, upon the grounds hereinafter set forth; and WHEREAS, on June 20, 2006, pursuant to Executive Order No. 06-142, Governor Jeb Bush suspended Commissioner Winton from public office, and has prohibited Commissioner Winton from performing any official act, duty, or function of public office; from receiving any pay or allowance; and from being entitled to any of the emoluments or privileges of public office during the period of the suspension, which period shall be from the effective date until a further Executive Order is issued, or as otherwise provided by law; and WHEREAS, due to the suspension of Commissioner Winton, a vacancy exists in the District 2 Commission seat in the City of Miami, Florida, pursuant to §112.51 (3), Fla. Stat.; and WHEREAS, it is the desire of the Commission of the City of Miami, Florida, to fill such vacancy, by appointment, subject to meeting the qualifications of the office, pursuant to City Charter provisions relative to same; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 06-01127 (Version: 11 Printed On: 2/6/2017 File Number: 06-01127 Enactment Number: R-06-0377 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Linda Haskins, subject to meeting the qualifications of the office, is appointed as a member of the City Commission of the City of Miami, Florida, District 2, to fill the vacancy created by Governor Bush's suspension of Johnny Lee Winton, to serve until such time as the results have been declared and certified for the Election to be held on November 7, 2006, or until Commissioner Winton's suspension may be revoked pursuant to §112.51(6), Florida Statutes (2005), whichever may occur first. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
