REQUEST: To Amend the Miami Zoning Ordinance APPLICANT(S): Joe Arriola, Chief Administrator FINDINGS: PLANNING DEPARTMENT: Recommended approval. PURPOSE: This will allow temporary automobile sales by Class I Special Permit subject to limiting conditions. WHEREAS, the City of Miami Planning Advisory Board (PAB) considered this item at its 2006 meeting, Item No. and by a vote of _ to has recommended the adoption of this item to the City of Miami City Commission; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its citizens to amend its Zoning Ordinance as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA, AS FOLLOWS: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City of Miami Zoning Ordinance is hereby amended by amending Article 9, Subsection 906.9 as follows: {1} "Article 9 General and Supplementary Regulations Sec. 906.9. Temporary special events; special permits; criteria. Section 906.9.1 Temporary Automobile Sales. City of Miami Page 1 of 2 Printed On: 3/6/2006 File Number: 06-00367zt Temporary Automobile Sales are permissible on privately owned or City owned land by a Class I Special Permit, subject to the applicable criteria in Section 1305.1 and in addition, the following conditions, criteria and limitations apply: A) Temporary auto sales shall only be permitted on sites 5 acres or greater and in G/I zoned properties or zoning districts that allow car sales as a permitted use. B) Temporary auto sales shall not be conducted any closer than 300 ft. from any residentially zoned property within the City of Miami. C) A temporary auto sales event shall be held for a maximum of 6 consecutive days D) Only one temporary auto sales event shall be permitted per month per site. E) A department of Motor Vehicles current dealer license shall be provided with the Application for Class I permit F) Any proposed tent, air balloons, or banners shall be situated for clear of all ingress or egress points. G) Applicant shall be responsible for all trash removal after event. H) Restrooms or portable toilets shall be made available to all patrons and employees. I) Separate sign permits shall be required for any balloons or banners. * *„ Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective ten (10) days after approval at second reading, unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission. APPROVED AS TO FROM AND CORRECTNESS: JORGE L.
