Request: Appeal of a Zoning Board decision of Class II Special Permit appeal, Application No. 04-
0198, approved with conditions by the Planning Director on October 27, 2004 for new
construction.
Purpose: The approval of this appeal will not allow the new construction of a mixed -use structure.
Findings:
Planning Department: Recommended denial of the appeal and uphold the Zoning Board's decision
of the director's decision.

Zoning Board: Denied the Class II Special Permit appeal on December 13, 2004 by a vote of 7-1.
Zoning Board Resolution: ZB 2005-0960
City Commission: Granted the appeal on March 10, 2005, reversed the decision of the Zoning
Board and denied the Class II Special Permit.
Note: On October 18, 2005, the Circuit Court ruled to quash the City Commission's decision and
remanded this case for proceedings.
City Commission: Continued on November 17, 2005 and December 1, 2005. Remanded to Zoning
Board on January 26, 2006.
Zoning Board: This item was continued from the Zoning Board hearing of February 27, 2006.
Denied the appeal on March 13, 2006 by a vote of 6-2.
