On behalf of the property owner, we are submitting a Major Use Special Permit for
approval of 129 residential, units and 150 parking spaces pursuant to Articles 5, 17 and 914 of the
Zoning Ordinance. In addition, we are also requesting approval of a waiver of Section 3 (mm) of
the City Charter. The building will be setback 23 feet from the seawall. Due to the size and
depth of the lot it is not possible to set the building back fifty feet. However, pursuant to Section
3 (mm) (iii), the City Commission may modify the setbacks based on a finding that public
benefits such as direct public access, public baywalks are being provided which better the urban
environment. This project is providing a public baywalk from NE 26 Street to NE 26 Terrace.
The project is also providing public amenities with a 10 foot wide bay promenade and a publicly
accessible plaza at the end of NE 26 Terrace and a park at the end of NE 26 Street. Currently
there is no baywalk.
