HomeMy WebLinkAboutVariance CC AnalysisAnalysis for Variance for the 1080 BR1.CKELL MUSP located at 1110 Brickell Avenue File No. 06-00419v Pursuant to Section 605.8 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for Variance as follows: Front yard Setback (S.E. Miami Ave.): Required - 20'-0" Proposed - 10'-0" Request to Waive - I0'-0" The following findings have been made: It is found that the subject property and location, as an interior lot, between Brickell Avenue and S.E. is` Avenue and with an existing office building structure already locate within the site and the additional request of the City to incorporate liner units to the proposed parking garage structure causes a substantial hardship, which limits reasonable use of the property, therefore the requested front yard setback variance is justified. These front yard setback variance is the minimum possible variance for reasonable and effective use of the new residential tower as part of this MUSP. • It is found that granting of this variance will not have an adverse effect on the adjacent area due to the particular nature of the use proposed. • It is found that the grant of this variance, for the specific use that the applicant is requesting, is in harmony with the general intent and purpose of the SD-5 "Brickell Avenue Area Residential -Office Districts" and is not injurious to the neighborhood. Based on these findings, the Planning Department is recommending approval of the application as presented.
