Re: Camillus House: Development Agreement by and between the City of
Miami and Charity Unlimited of Florida ("Development Agreement")
Dear Mr. Arriola:
On behalf of Charity Unlimited of Florida ("Charity Unlimited") and Camillus House,
Inc., we request that Camillus House, Inc. be substituted for Charity Unlimited as the
party to the above -referenced Development Agreement. Assistant City Attorney Rafael
Suarez Rivas asked that we notify you of this change and explain the reasons behind it.
Accordingly, please note that because Charity Unlimited is a real estate holding company
with limited operational capacity, it determined that the more appropriate entity to enter
into the Development Agreement is Camillus House, Inc. As the party that will carry out
the relevant obligations under the Development Agreement, Camillus House, Inc. is the
proper party to the Development Agreement.
The Development Agreement remains properly noticed to be considered by the City
Commission on June 8, 2006. Pursuant to Ch. 163.3225(2)(c), Fla. Stat., public hearing
notice requirements for development agreements are limited to the following: "The
notice shall specify the location of the land subject to the development agreement, the
development uses proposed on the property, the proposed population densities, and the
proposed building intensities and height and shall specify a place where a copy of the
proposed agreement can be obtained." The statute does not require the parties to be
named in the notice; the notice, therefore, complies in all respects to the statute's
requirements. Nevertheless, it is clear from the body of the Development Agreement
and other materials that Camillus House has always been an integral part of the
Development Agreement.
Under separate cover, you will receive a resolution that authorizes Camillus House, Inc.
to enter into the Development Agreement.
