A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS
(4/5THS) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S EMERGENCY FINDING; WAIVING THE REQUIREMENTS
FOR COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT TO
SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA;
AUTHORIZING AN AWARD OF A CONTRACT TO TEN-8 FIRE EQUIPMENT,
INC., FOR THE IMMEDIATE REPAIR OF A DAMAGED BASKET ON AERIAL 1,
FOR THE DEPARTMENT OF FIRE -RESCUE, IN AN AMOUNT NOT TO EXCEED
$36,310; ALLOCATING FUNDS FROM THE FIRE ASSESSMENT ACCOUNT
CODE NO. 109001.280905.6.840.
WHEREAS, the City of Miami's ("City's") Department of Fire -Rescue has a shortage of spare
Aerial type trucks available in their fleet; and
WHEREAS, the City's Aerial 1 truck hit a !ow tree in the area of Coconut Grove and received
damage to the basket; and
WHEREAS, Ten-8 Fire Equipment, Inc., is the local sole source vendor of Pierce Manufacturing,
Inc., parts and has the necessary knowledge and training of these types of vehicles, therefore
preventing the need for at the very least to obtain informal quotes; and
WHEREAS, the City Manager has rendered a finding that the immediate repair of said fire
apparatus is an emergency for the City and for the safety of its citizens;
NOW THEREFORE, BUT IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (415ths) affirmative vote, the City Manager's emergency finding, waiving
the requirements for competitive sealed bidding procedures, pursuant to Section 18-90 of the Code of
the City of Miami, Florida, as amended, is ratified, approved and confirmed and the award of a
contract to Ten-8 Fire Equipment, Inc., for the immediate repair of a damaged basket on Aerial 1, for
the Department of Fire -Rescue, in an amount not to exceed $36,310, is authorized, with funds
allocated from the Fire Assessment Account Code No. 109001,280905.6.840.
Section 3. This Resolution shall become effective immediately upon adoption and signature of the
Mayor. {1}

Footnotes:
(1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
