A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT FUNDS FROM THE FLORIDA
INLAND NAVIGATION DISTRICT ("FIND")WATERWAYS ASSISTANCE
PROGRAM, IN AN AMOUNT NOT TO EXCEED $28,350, TO REPLACE THE
EXISTING DETERIORATING SEMINOLE PUBLIC DINGHY DOCK IN THE DINNER
KEY AREA, TO ELIMINATE THE POTENTIAL HAZARDS AND PROVIDE SAFE
DOCKAGE FOR THE DINGHIES AND TRANSIENT VESSEL OWNERS DESIRING
TO GO TO THE MAINLAND FROM DINNER KEY; APPROVING THE
ALLOCATION OF THE CITY OF MIAMI'S REQUIRED MATCHING FUNDS, IN AN
AMOUNT NOT TO EXCEED $34,350, FROM THE DEPARTMENT OF PUBLIC
FACILITIES FISCAL YEAR 2005-2006 GENERAL FUND OPERATING BUDGET
ACCOUNT NO. 414000.350506.340; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE FIND PROJECT AGREEMENT (PROJECT NO. DA-MI-05-90), IN
SUBSTANTIALLY THE ATTACHED FORM, AND TO COMPLY WITH AND
EXECUTE ALL OTHER NECESSARY REPORTS AND DOCUMENTS TO
IMPLEMENT ACCEPTANCE OF SAID GRANT AND TO ACCEPT THE TERMS
AND CONDITIONS REQUIRED BY FIND RULE 66B-2 F.A.C. GOVERNING THE
WATERWAYS ASSISTANCE PROGRAM.
WHEREAS, the waterways of Dinner Key provide access to the Atlantic Intracoastal Waterway,
Biscayne Bay, the Florida Straits and the Atlantic Ocean and rest directly adjacent to the public boat
ramp that services the transient vessels docked at Dinner Key Marina and the proposed Dinner Key
Mooring Field; and
WHEREAS, the current existing wooden dinghy dock is deteriorating from use and weather aging
and poses potential environmental and safety hazards to the public and maritime community,
therefore, mandating the replacement of the existing Seminole Public Dinghy Dock to provide a safe
structure for transient boaters to dock their dinghies and continue on to the mainland ("Project"); and
WHEREAS, pursuant to Resolution No. 05-0184, adopted March 24, 2005, the Department of
Public Facilities submitted a grant application to the Florida Inland Navigation District Waterways
Assistance Program ("FIND") for funds in the amount of $28,350 and has been awarded the amount
requested; and
WHEREAS, the estimated cost of the Project is $62,700, which is inclusive of applicable
engineering, design and permitting costs; and
WHEREAS, the City Miami ("City") will provide the required matching funds of $34,350, to afford
the completion of the Project from the Department of Public Facilities General Fund Operating Budget;
and

WHEREAS, the FIND Project Agreement (Project No. DA-MI-05-90) requires completion of the
Project and submission of all required payment reimbursement information on or before September 1,
2007 unless the Project period has been extended with prior written approval of FIND;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to accept funds from FIND, in an amount not to exceed
$28,350, to replace the existing deteriorating Seminole Public Dinghy Dock in the Dinner Key Area, to
eliminate the potential hazards and provide safe dockage for the dinghies and transient vessel owners
desiring to go to the mainland from Dinner Key.
Section 3. The allocation of the City's required matching funds, in an amount not to exceed
$34,350, from the Department of Public Facilities Fiscal Year 2005-2006 General Fund Operating
Budget Account No. 414000.350506.340, is approved.
Section 4. The City Manager is authorized(1) to execute the FIND Project Agreement (Project No.
DA-MI-05-90), in substantially the attached form, and to comply with and to execute all other
necessary reports and documents to implement acceptance of said grant.
Section 5. The City accepts the terms and conditions set forth in FIND Rule 66B-2 F.A.C., which
govern the Waterway Assistance Program and which is a part of the Project.
Section 6. The City agrees to carry out the Project in the manner described in the proposal, and
will make no change to any plans and specifications, without prior approval of FIND.
Section 7. The City will maintain adequate financial records for the proposed Project to
substantiate claims for the reimbursement.
Section 8. The City will make available to FIND, upon request, a post audit of expenses incurred
on the Project prior to, or in conjunction with, the request for the final ten percent (10%) of. the funding
agreed to by FIND.
Section 9. The Resolution shall become effective immediately upon its adoption and signature by
the Mayor. {2)

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
